I can think of a few things. I am from Australia but we still loaded the application. However, I didn't provide passport stamps as we did ESTA and ETA and I didn't know you could get electronic entry and exit via I-94 and the Australian version. I already downloaded the PDF of the I-94 and need to apply for the Australian one for my fiance if that is what it is.
Otherwise maybe my divorce certificate. We went it in but it is electronic only BUT that is how they are all done in Australia so shouldn't be an issue.
Or maybe the intent to marry letters as a few people have RFE for those. We followed the template and wet signature but you never know.
Criminal MAYBE. He has no convictions at all but when he was young him and his dad got in a fight and to 'teach him a lesson' his dad called the cops who took him to the station. That was all included though and no charges too etc.
Otherwise maybe he did forget to sign or tick something.

 

I think it has to be something that I listed. Which are all faily easy to overcome.. I think.

 

Hopefully yours come soon! I don't mind the delay because I am not moving until July but it is the not knowing and it all being up to a stranger that makes it hard.

 

Yes, all manageable it seems which is good. 

 

I've been through a divorce too and submitted my official divorce paper. There were no questions asked in the RFE.  From me as the petitioner, it was straight forward as I just followed the requirements for China on the travel.state.gov website. In your case, you're the beneficiary so it might be the same though I know if you were the petitioner that got a divorce, the required documents would be noted here: https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/australia.html.   

 

If he reported the police station issue, they might require police records, court records, and maybe an affidavit even if he wasn't charged and was dismissed.  It's not clear though as some applicants don't get asked for this at all. No denial reports I've read had issues with this one unless it was a felony or domestic abuse. 

 

Intent to marry is usually pretty easy to satisfy I think. If they require that, I can share what I did for the RFE though I haven't been approved yet so we'll see what happens. 

 

Anyways, best of luck!  Definitely agree it's the not knowing part that makes it a bit stressful. In any case, given my paranoid personality, I've read through at least 50+ denial reports and as I noted in the above comments, the denials only happen in specific cases that I think are mostly reasonable. So I think we're all pretty safe, it just takes time.

Yeah, I think it will be manageable. It is just waiting for the letter to see what we need to do. I am a paranoid person too and always anxious and so I expected a RFE even though I thought our petition was good. Although now that I have one I am even more scared than before.

 

Well I included my marriage certificate (for name change) and divorce so I should be good on that front. He did report the police thing but it was a non-matter so I don't really know if that would cause a RFE or not. I saw someone here not get a RFE on a charge when they groped a minor and if that can get a free pass (no offense to that person) then this should be fine.

 

Would love to see what you did if it is intent to marry so I will let you know when I get the letter.

I was in a middle of a crisis with my family and was pessimistically checking my case tracker app (linked to egov website) and saw that my case was approved (on day 59)!  

 

Quite unexpected because I called yesterday (day 58) and they gave me the usual spiel about waiting until the 60 day mark to call back.  I asked them to escalate and they said no and repeated again to wait until the 60 day mark. I voiced my concerns a bit on the phone telling them that others were getting approved much earlier and that I'm worried that my application has problems or has been forgotten. 

 

Anyways, I'm happy to get approved, but also empathetic towards people who are still waiting. It's been quite stressful.  

 

All I can say is hang in there and maybe call USCIS to check up. I've called them a couple of times before so I don't know if it's just coincidence or what. Someone else in this thread, much earlier than me also called them and the next day they got approved though many call and don't get any approval until way later. So, it's weird.

Received our RFE letter today that was posted on the 16th and it is for court documents relating to a fight that my fiance had with his father that he was then arrested for. In hindsight we should have included them but y'know.

I am a bit stressed now because it is an awful time of year. Hopefully the courthouse is open Monday so he can get them as he flies out to me on Christmas Day for a month so otherwise the RFE will be stalled until then and I hope that he can get them as soon as he gets back and the process is fast.

 

Anyone else been in this situation? He is going to the courthouse to get the disposition that should have all of the information on it. Stamped with ink signature.
Also going to get the police record from the station if possible.

 

If these don't exist letters explaining that. Send the originals.

 

Am I missing something? I am super anxious about this as I just want to be with him already.

Sorry for the double post but I’m hoping for some advice.

 

My fiancé went to the police station yesterday to get his report which was able to be presented but they said SD state law they can’t hand it over and send it direct so they were in the process of doing that. I woke up and told him to stop doing it as we need to send things together and need the court documents with the final disposition so he got that paused.

 

He went to the court but it’s closed for three days over Christmas so he won’t be able to go there until after he is here for a month. We will still have about six weeks left of RFE time when he gets back so that’s fine. It means I’ll worry but technically no issue. I’m hoping the court will give him the documents and not have the same law?

 

He called USCIS and they said they don’t care who the documents come from as long as it’s complete. So he told me his plan was to get the court documents (if he can) or they give to the police if he can’t and he will add the RFE letter and they will send it away. I’m a little uncomfortable with this as it’s very important and I want to make sure we send it ourselves and to the right place. I feel as if the court gives us the final disposition that includes when he was arrested that we should forgo to police statement so we can send it ourselves. What do you think? I’m sure he could get the police records through the freedom of information act but I’m not too sure as it’s not my country.

 

What would you guys do in my situation? I’m a little freaked out about it and of course really want my approval. So with a month to wait until we can work on it I want a solid plan.

 

Oh also do we include another form for electronic notification that it’s received this time?

Do you think this basic RFE will also take 60 days until approval? 

For something small like that, it's usually quick like < 2 weeks.  Someone earlier this year forgot to tick a box and it took a month.

It's good you got the RFE explanation. 

 

Can you post the RFE here so I can see the exact requirements (you can black out the personal/sensitive info)?  By the way, I think you need to quote me or reply somehow because I don't get email notifications otherwise I think.

When they send out the RFE notice, the adjudicators don't just sit around waiting for the response. They start working on the next awaiting file, and they will likely finish processing or whatever needs to be done with that file, prior to even re-opening the first file that was awaiting a RFE response. I would sincerely hope that they work one file at a time, so as not to get distracted. B-)

Think it might take longer due to the holidays as everyone gets holidays and some agents might take extended time off.

Yes me too.

 

Problem is that it also depends on the adjudicators - some are slower than others or more careful.  

 

I've seen cases where Petitioner A has the same RFE issue as Petitioner B, ceteris paribus. Petitioner A sends RFE two weeks before Petitioner B, but Petitioner B still gets the NOA2 approval first.

Agree with you, but for this case Sophie isn't saying she is worried.  Not sure why you're overreacting ... 

 

Note that the very nature of these threads is to provide progress reports, feedback and discuss timelines.  People will have different experiences.  It's okay to talk about it.
