It is my understanding that if a minor is above age of consent in their home country, communicating with them with the aim of courtship breaks no law. Entering into a relationship with them when they are above the age of consent also breaks no law. However, this person may or may not be marriageable according to the laws of their home country and/or US laws and that should be sorted out before filing. There is a whole bunch of court and USCIS documentation on this issue, mainly dealing with arranged marriages with minor females to battle trafficking. But it is my belief that the approach will be the same.

From what I saw here, a poster was given a very hard time for communicating with a minor in a romantic and/or sexual way. It was almost implied to the poster by the CO that they had specifically looked for a minor for a relationship. Although in the country where the K-1 applicant lived the age of consent is much lower than the US, when you deal with immigration you have to answer to two different authorities and two pairs of eyes looking at you.
