MIL is certainly deportable in the meanwhile if this is the intent, though. I know there were cynical comments above about the likelihood of this happening, and it's true that in the past otherwise law abiding individuals were left alone, but there have been an increasing number of reports about people being deported just because USCIS got to know about them.

So ... I realize everybody here accepts that the extension will be denied, and based on the reality of the reason, I agree.  But how much does USCIS investigate if the attorney put something that might be considered a valid reason ?

USCIS is so hugely backlogged that anything in the realm of routine doesn't get investigated much, if at all. People lie on visa/immigration documents all the time, and that's a sad fact. 

 

Extension requests are facing elevated scrutinized of late, so there's a chance this would get denied for the mere fact that a visitor is requesting to spend more time on a non-emergency.

They don't do much "investigation" of that at all---depends on the validity of any evidence submitted as to the reason for extension.  All MIL would need to do is below (from the i-539 instructions)~

 

Submit a typed or written statement explaining in detail:

 

A. The reasons for your request;

B. The reasons why your extended stay would be temporary, including what arrangements you have made to depart from the United States; and

C. Any effect the extended stay may have on your foreign employment or residency

 

If it's an emergency/medical/out-of-the-person's-control reason, it stands a higher chance of being approved than just a reason for wanting to visit with their grandchild more, for example.

Yeah, for cases like b2 extensions, i believe they wouldn’t even think of the word “investigate”. Spending just two hours on one case may already burn the entire i539 fee.

 

As soon as they read the statement about B2 extension, i think they decide within a minute thru the following methods:

1. Logical: looks realistic- approve, looks unrealistic/exaggerated - deny

2. Hunch: approve or deny without giving much thought on statement

3. Coin Toss: making boring review job interesting

4. Alternate with the adjacent colleague: you approve, i deny and vice versa, passing days in a more fun way.

@HappyAndIKnowIt First I want to say I sympathize with you. You seem to have thought everything out and have a lot covered. Im not sure how much more advice you can get besides whats already been told. Plus this thread is turning more into a relationship issue then an immigration one... Immigration wise the MIL will have various issues. Please understand that NONE of her immigration issues will be of any help to you in family court (except obviously for her actually departing the US, so she wont be here). If she is illegal or a tourist or a pending whatever it does not matter to family court. You have so many other valid things that you can use as an argument in family court- pursue them and let the immigration aspect of her status go.

Yep.  Thanks.  I responded to my belief that I was on the hook with the AoS, whether I was wrong in that belief or not, it's done and out of my hands.  If USCIS contacts me for more information, I will invite them over and we'll have a nice chat.  If not, what happens, happens.

 

I'm looking forward to upcoming warmer weather and time with my son away from the house, and away from MIL.

 

Btw, is the acronym "MILFH" a thing yet ?  Maybe I'll buy her a "MILFH" baseball cap.

The financial aspect is my most significant factor for divorce.  As biting as the cost is and will be now, the burden I save myself and my son down the road from my wife and her decisions is huge.  MIL will be 65 later this year.  My wife has no concern for the pending health care costs of her mother.

Her priorities appear misplaced. 

 

Maybe getting to the US from Ukraine trumped everything?
