Of course they should be. If you overstay you ought to be denied immigration benefits for a time or permanently. If you cannot follow immigration laws, then odds are you won't follow other laws either. AGREED

The next crackdown should be on bogus asylum claims. Gang violence, your husband beating you, or just "wanting a better life" are NOT grounds for either asylum or immigration but I digress. AGREED

 

I absolutely support president Trump's agenda and will vote for whoever will continue it in 2024 after I'm Naturalized. NO POLITICS HERE. VOTE FOR WHOEVER YOU WANT AFTER NATURALIZATION

I must admit I have overstayed my visa for  2 weeks ( due to bad timing of 2018 tax returns etc) . 

Now have pending AOS . Why I am doing my AOS from B2 is longer story but definitely not my intention. I am aware that I have violated terms of my non immigrant status and ( by this current law) I am expecting  to face the scrutiny at the interview. So basically I have been an illegal alien for some time ( 14 days) . That makes me a criminal who should be deported right away ( as someone has written)and put me exactly in the same group as the people doing AOS after living illegally here ( overstaying visa as me )for 5, 10... even 20 years , working all the time without authorization and without a single cent payed for taxes .

I am not complaining - I am exactly one of those you are discussing about. 

And you are right.

You are right! husband beating you or wanting a better life are not grounds for asylum, not even TODAY....

 

If you think it is that easy to get asylum why you didn't try it? Heard Bulgaria is a pretty rough place. (While you go into a grocery store they break in your car if you have a foreign plate on your car, police stops you for petty things and you can get out only if you bribe them...)

 

Anyway, did you EVER went over the speed limit? Even with 1 mile? Crossed the street where you was not supposed to? If yes, you should be deported because you can't follow the laws...... Basically that what you are saying.....

 

Btw Trump would kick out your ### too if he could.....

And if you would knew some basic government stuff.... in 2024 he won't be running for presidency......

 

I think you are looking at the words too logically and not as US Courts have interrupted them.

 

Reminds me of the German Family who were able to make a successful claim, based on home schooling.

On a different matter I agree that visa/esta overstay is basically hurting other legitimate travelers because they are more scrutinized/ some countries have no ESTA because of high overstay...

 

Yeah sometimes there is no other way but marry on b1/esta, but that should be very very rare....

We shouldn’t be using this platform for political propaganda, first off. Secondly, if you come here on a K1 visa, you’re also choosing an ‘easier way’ to hop over the immigration system (which are also taken advantage of), why not wait in line to come to the US ready to work and contribute to the economy upon entry? A visitors visa (unless you have a waiver), is a very expensive privilege not granted blindly, if you overstay a visa, you’re out of status l not ‘illegal’ because overstaying is a civil offense not a criminal one. Also, just fyi, while you’re waiting for a K1 aos, after your 90days are over you’re also in that nebulous of being out of status, i94 is expired, the noa itself says ‘not an immigration benefit’ so, if we go by that, then technically you’re illegal too? So choose comments wisely because you’re an immigrant too, wait until you’re here without a work permit or a valid i94 until whenever, like most k1 have to 👌🏽

You have people that have NEVER been in the US before and that’s a fast track to come to the country and on top of that, is a sedentary one, you’re basically skipping consular processing which is the true line, if we’re 100% technical about it and even consular processing could be scrutinized all the way down to: how did that immigration genealogical tree started? That’s all I’m saying.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I wonder, are overstays more prevalent from ESTA countries?  If so, maybe the US should revisit the countries on that list.  As to comprehensive immigration reform, Congress will need to get involved, and that most likely will not happen anytime soon.  Both sides love using this as political fodder.
