I can confirm Vegas has no waiting period. You can get your license and get married 5 minutes later on the steps of the license bureau. My friend is a licensed mobile Minister, can marry you for 100 bucks anywhere in Las Vegas with 20 minutes notice. PM me for her number if you want to do the Vegas thing. She did my wedding no issues.

Wait until she gets her tourist visa before making any plans.  Good luck for her to get a tourist visa as a single female from the Philippines.

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

After marriage.  Which form i should apply cr1 spouse visa of AOS? She wants to go back in the Philippines and stay there for few months and come back to US as tourist for few weeks and come back to the Phippines while waiting for AOS or spouse visa cr1 petition? Is Aos n cr1 visa petition different? What form should i use on this case?

She will not be doing AOS. She will just apply for the CR-1 visa abroad.

Process:

  1. Marry
  2. File I-130
  3. Wait for I-130 approval (~7-10 months?)
  4. Approved I130 is sent to NVC
  5. NVC processing (http://www.visajourney.com/wiki/index.php/NVC_Process)
  6. NVC Case Complete: Waiting for an interview at the embassy/consulate
  7. Complete medical, translate documents, etc.
  8. Interview at embassy/consulate
  9. Administrative Processing (AP). Days/Weeks/Months/Years, depending on what is involved (not all AP is equal).
  10. Visa issued
  11. Visa and passport received
  12. Travel to US on CR-1 visa. Physical green card arrives in the mail later (after payment of the fee).

NOTE: She will need to complete GCP in the Philippines and get a sticker in her passport. This is a Philippines government requirement for people immigrating to other countries. The sticker can only be placed after the visa is issued.

Yes.

She can visit using the existing visa fine, subject to CBP inspection as always.
