I have the same question and can not find a good answer.

http://www.visajourney.com/forums/index.php?showtopic=67620 is the closest i could find for someone on a k-1. Looks like we are OK even without the EAD card.

I am nit sure if the school even cares if the student is already legally in the US.

I am nit sure if the school even cares if the student is already legally in the US.

Yes the school will care about your legal status -- to make sure you are legal and to allow you to be a student. (For example, people on a tourist visa are not authorized to go to school therefore they could not attend).

Your EAD has nothing to do with school. An EAD is Employment Authorization and you are not talking about working. There is no relationship between the two.

The easiest way to get answers about this to contact a couple of the prospective schools and ask about their requirements - most likely those include English proficiency tests and proof of your prior schooling or placement exams.

Yes, you are allowed to attend school when you have entered the US on either a K1 or K3. Many people do it.

It's not an issue with USCIS in the way that it would be if you were, for example, on a tourist visa and wanted to work. Employment authorization and your EAD have no relationship to the desire to go to school. These two things are not connected (unless you ultimately want to work at the school).

The important details are about the prospective school's requirements.

They will want proof that you speak English and you will most likely be required to pass the TOEFL exam. They will want some kind of proof of your previous education and you will most likely be required to pass placement tests.

The easiest way to get answers about this is to contact the schools directly. They are accustomed to international students and people on visas so it shouldn't be too hard to get clear, straight answers.

My wife will be going to school as well, I want her to go as I figure it'll be easier for her to make friends and enter American culture easier, she'll be leaving a lot behind in Taiwan and it's the least I can do for her.

From what I know, yes you can, but it's better to wait until after AOS. On a K3 you will be charged as an international student, which isn't cheap. In Georgia, my wife will qualify as an in-state student after she goes through AOS. I'm sure it's similar in other states.

I called the school and they said it is no problem to enroll or attend classes on a K-3. hope this helps.

PS Please verify with your own college since they might have different requirements.
