After speaking to an attorney it appears I made a mistake on my I-485. They initially said I should prepare a sworn statement with corrections to take to the interview but then they dug a little deeper and are now advising I re-submit the form, but my work permit/travel authorisation are already in progress so I’m wondering whether resubmitting with corrections will put me to the back of the line on everything or just the I-485, or whether it will actually not loss my place at all but rather just update the form??

 

For reference, I submitted about a month ago and have already received my NOAs for EAD, AP and my biometrics interview....

I got my biometrics interview date through but it happens to be on a day when I have a REALLY important event planned. I could probably make it earlier that day but the appointment is for right slap bang in the middle of that time...

 

if if I show up at the USCIS office earlier, is there any likelihood that they might be able to see me earlier? I tried calling them to ask in person but they were closed... Also I know I can just request a postponed date/time but I’m headed out of state for 3 weeks right after that and I just KNOW I’m gonna miss any rescheduled date they offer me.... I don’t want to postpone too long as I’m worried it might delay my entire green card process....

 

Anybody have any tips or find themselves in the same situation? What did you do??

Would the error not be recognized by USCIS and an RFE issued?

You can usually do a walking before hand. Lots of ppl have done so.

I was successful with an early walk in. My best advice is to do it on a Wednesday. Monday and Fridays are bad, Tuesday is catch up from Monday, and Thursday is " Glad I only have one day left to Friday"  We went on a Wednesday after lunch and I thought the office was closed it was so empty in the lot. Walked in and had no problem as we were the only people in the Biometrics office, took longer to get thru the metal detector than the biometrics. This is the reason you will see people call it " Walk in Wednesday", because it is the best day. This is from my experience.

Wow, wait, so you had a successful walk-in not only at a different time but on a completely different day? That’d be great if so; I may try this....

I ticked the wrong box on one of the questions; it was a question that won’t be a ‘bar to entry’ given my marriage to a US citizen spouse, but I’d still like to clarify it so USCIS don’t think I tried to lie to them...

That can be clarified at the interview.

Yes, completely different day and time. Wanted to get it done early to hopefully speed things up. Only a week early, but every little bit helps.

Walk-in policies vary by ASC. Some will do it fine and not others.

 

Refiling would lose your spot in line as it is a completely new filing. I wouldn’t generally suggest it versus just correcting a mistake.

Yeah that’s what my attorney told me too, and they told me I should prepare a signed sworn statement but then they dug a little deeper into my specific situation and suggested I resubmit...hopefully with clarification they won’t lose my place in line 🤞

I mean, it wasn’t just a mistake like putting the wrong address, but rather like saying I hadn’t done something when I actually had, because I didn’t understand the question fully. So I’m just concerned it could be misconstrued as trying to hide something.... maybe I’ll call the customer service line and see what they say...

Just note if you resubmit, you will have to pay all of the fee's again.
