My petition for my mom got approved last month and I just started filling out the Form I-864. I'm at the Federal Income Tax section of the form and I'm not sure how to fill out a few things. I'm still waiting on the 1099 from my employer for year 2018 so I still haven't filed my taxes yet. I did file taxes for year 2017. If I were to submit the form today, would the 2017 tax return be sufficient or would it be considered too old?

 

The form asks whether or not I filed taxes for each of the three most recent tax years and also the income amounts for those years. As far as I understand, I'm only required to send in the most recent tax return. Can my application be denied if I didn't file taxes for 2015 and 2016? I did have some income but I wasn't able to file.

 

Also, I do work for a company and have a job title but I'm not on a W-2. I receive 1099s like I mentioned earlier. Do I have to specify Self-Employed (Part 6 Item 4) or can I just put my occupation and employer name (Part 6 Items 1 & 2)?

 

Any suggestions/advice will be greatly appreciated!

  • They may consider 2017 as the latest if you file today as technically there few days left  but they may not . To be safe and if you have no intention to submit tax extension request, file the tax today and submit 2018 tax with 1040 + W2/1099 + all schedules.
    • It is better to do some extra steps now than to be sorry later.
  • You may to explain why you did not file 2015 and 2016.
    • On your section to submit I-864, you can add other document and add your explanation.
  • You are considered a contractor to your employer (income reported on 1099 - Box 7 ),  use Part 6 Item 4 is appropriate.

Thank you for your response. I did file for an extension for 2018 taxes already. I'm just trying to determine if I should just submit the I-864 now with the 2017 tax return or wait until I'm able to file 2018 taxes and then submit.

 

In your experience, if I submit it the form with 2017 tax return and it ends up being insufficient/not recent, will they give me a chance to fix my mistake/provide them with 2018 tax return or can they just deny the petition altogether?

Petitin is already approved.   If they deem the income insufficient then any further processing will stop until you resolve

As you already filed your extension, you may just upload 2017 with the proof of extension filed.  

  • Yes, they will give you chance, actually several chances. However, it will add delay in your case.
