Sorry to hear about the RFE. I sent almost the same documents, No children and house is paid in full (No rent or Mortgage docs). I have to wait and see what they say...

Check the excel file: Mydy submitted in end of March/beginning of April and Mydy's case is now being processed. You can compare that to other cases in the file

Ok, got my letter from USCIS: 

 

Good faith Marriage, Insufficient Evidence.

They want me to send evidence that we have resided together and shared common residence such as:

 

1. Leases in both names showing joint occupancy

2. Deeds and mortgages in both names showing joint ownership or

 

**we dont have these documents as we are living in my husband’s family home and is not named after him as his parents passed without doing so. It is not uncommon here in Guam for extended families living in one roof.  We are actually saving enough money for closing costs as we plan to build our own place next year.

 

3. Copies of your and your petitioning spouse’s drivers licenses and/or identity cards from appropriate state’s motor vehicle department.

 

*i never learned how to drive. My husband or my son drives/pick me up to/from work.

 

Evidence you and your spouse have combined financial resources or joint ownership of assets and responsibility for liabilities such as:

 

1. Checking, savings or investment accounts statements showing transaction pages.

 

2. Loan or credit card account statements.

 

* we have Credit Card  statements showing our name. 

 

Evidence you and your spouse made estate, health and financial planning arrangements with each other as a will, trust or durable power of attorney for health or property or both.

 

*Is it too late for us to do this?

 

Any other relevant documents not already mentioned. - I can send them another copies of our pictures together at our company 2018 Christmas party, also updated 2018 W2.

 

This is very frustrating, it is giving us stress as we cannot provide everything they need.

Katia Nebraska does not seem to sent biometrics until much later. You might even just receive the green card without getting any additional notices. I filed in August 2018, have not received a biometrics letter

MyDy I think you should get a will done. i did, it really doesn't take too long. While others might disagree with me, I think you should also open up a joint checking account (with funds of course) and use that as evidence as well. While you do not know how to drive, get state IDs from the DMV: it will serve the same purpose and show that you are living in the same house. It seems that USCIS is looking for financial comingling, I don't think pictures will help as much. In regards to living arrangements, have your parents write you a statement explaining that you are living with them.

  • February 19, 2019 - Electronic Notification Rec'd, Case Location LIN - Nebraska;
  • February 21, 2019 - Received NOA with 18 month extension for wife ONLY, not 14yo dependent who is on application;
  • March 12, 2019      - Notified USCIS that we never rcvd i797 for 14 yo minor, they provided a case # and submitted a Svc Request
  • May 2.2019             -  No forward motion, we called again and despite there was an officer assigned to this service request nothing happened/ no extension. We filed an InfoPass and have an appointment for Monday 6th for passport stamp.
  • May 6, 2019 - Attended InfoPass appointment in Philadelphia local USCIS local office for 930. This was for a never rcvd 797 for our 14yo dependent. Arrived 9:15, not crowded at all. No extra photos or fingerprint taken. We were in the car (lots of parking available) at 945. Pleasant female officer, she updated and checked for no changes. Stamped passport, explained is valid for 1 year. The took the green card which expired 5/4/19. No issues or problems.. I asked about the non receipt and she said it's pretty common.. 
  • August 23 - Biometrics NOA, scheduled for 9/3 @1pm
  • September 3 - Biometrics
  • September 4 -Fingerprint Review was completed
  • January 8 - ROC, Card Being Processed, Citizenship is next!
  • January 15 2020  - Cards Delivered

 

N400 Citizenship :)

 

  • November 28, 2020     - N400 Filed online and paid via CC
  • November 28, 2020     - NOA received electronically

Which center did you file your I-751 to? Then was transfer to Nebraska?

I remember Nebraska center didn't directly receive 751 until September 2018.

Financial comingling - I sent them copies of our credit card bills and water bills with both our names on it, insurances with my and my boy as beneficiaries, my 401K with him and my son as beneficiaries.

 

 Statements from friends and families - we provided them these too.

 

State ID - tried doing that but DMV did not give me one since they want my passport to show my married name (even if I showed them my marriage cert and told them I will be applying for US Citizenship so there is no sense for me to have it updated) 

 

My husband will pay a visit to a lawyer tomorrow Friday to probably to make a will and ask for legal advise. My only worry is the present date that will appear on the will - I hope it wouldnt matter.

Yup, we did file jointly. We will be preparing the documents that We have and we will be taking care of other documents that can help them see that we do live together as husband and wife. Getting IRS transcript is a good idea, thank you!

Yes that’s correct: Nebraska started as a center in September. I submitted mine though towards the end of August to California. It was never ‘received’ by California and was diverted to Arizona eventually in September
