You can file the I-751 with a divorce waiver... plenty of people do it.

I’m not trying to get my husband “sent back”, since apparently people think that’s funny. It’s actually been something that keeps me up at night, worrying about irrational and unlikely outcomes of this. I feel guilt over it, like I uprooted his whole life for things to just not work out between us.

 

I feel like I’ve already explained this here, but whatever. This is a person I care deeply about, we just got married very young and realized we weren’t a good match romantically. 
 

I help him complete the necessary paperwork, even when it’s his application, because I am an experienced legal assistant that worked at an immigration law firm and was paid to work on cases like ours all the time.

Apologize I didn’t mean to upset you, as you are more than likely aware the Removal of Conditions application is to prove you are still together and have a strong relationship, because per the letter of the law (emotions aside) anything else means it is not a valid reason for a green card as many have exploited this path to citizenship wrongfully.

 

 

Waivers do exist but usually I assume they are intended for different reasons like violence, domestic issues, and USC passing away. I am no means an expert, this is my understanding and personal views as I truly don’t want this process to get any more stricter than it already is for K1 visa holders.

 

While most marriage waivers are approved there are quite a few that are not.

 

 

The only thing USCIS does in an instant is denials for ROC, there is absolutely no priority for ROC applications and many other applications take priority over us (like K1 and other similar petitions).

As far as the RFE, I sent more photos, 3 affidavits from people we knew, (I had sent 2 in the initial AOS) a DVD with our exchanging of vows from our wedding, our Power of Attorney papers. I had already sent them everything else. I think that they just randomly pick folks at times.

Waivers are intended for various reasons and he can file and prove that the marriage was bona fide but it didn’t work out. Nothing wrong with that. And Its not funny to make jokes about deportation and a person losing their entire life in the country they love. You should know better being in an immigration forum. I hope not to see those type of comments ever again in here.

I am still waiting for my divorce decree or at least the court date. Did you hire a lawyer to help with the waiver switch or no?

I am so hopeful sending the decree will push your case though for your guys. (I watch every day hoping your case is approved).

Well, September 2019 filer here. Had biometrics done on Jan 22 2020. And all that the USCIS egov site and my.USCIS.gov show is that my application has been received. Never anything about Biometrics, never a peep about fingerprints received. So are the Lincoln peeps unable to update the progress somehow?

Uscis case tracker has a red white and blue shield it’s available for iPhone,  use the search tab and enter a starting number, you can then search up to 500 minutes records. After searching, you can further filter it by form #
