just curious for those who want to leave say Christmas but probably will not have the green card by then........ the I-131 instructions  page 9 (C-1) for advanced parole for those inside the United States states you need a “USCIS document showing current status”, what exactly would be a USCIS document showing current status? 

 

Also on page 9 (C-3) it says if you are an applicant for AOS you need a receipt  from the USCIS showing you filed AOS. I’m not sure how you can have a receipt from the USCIS when your sending it all in initially.

What's your current status?

A K1 Visa Holder?

If so the documents that prove you are a K1 Visa holder are:

1) an approved I129F (your NOA2 Receipt notice from K1)

2) an approved K1 Visa (your K1 Visa sticker in passport)

3) proof you entered the US legally (your I94 stating that you and when you arrived on your K1 Visa)

4) proof you complied with the conditions of your K1 Visa by marrying your USC Petitioner within 90 days (your MC that proves when and who you married)

Yes my wife is a K1 visa holder. So what your saying is any of the four items you list will suffice for USCIS current status? 

 

 

Im also wondering about USCIS receipt on page 9 of the I-131 (C-3)?  How would you get that?

No, ALL of those documents combined prove she is a valid K1 Visa Holder and need to be submitted.

 

"c. Advance Parole Document for Individuals Who Are Currently in the United States

 

If you are in the United States, you must attach:

 

(1) A copy of any document issued to you by USCIS showing your present status, if any, in the United States; and

 

(2) An explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole Document; or

 

(3) If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application; or

 

(4) If you are traveling to Canada to apply for an immigrant visa, a copy of the U.S. consular appointment letter; or

 

(5) If USCIS has deferred action in your case under DACA, you must include a copy of the Form I-797, Notice of Action, showing that the decision on your Form I-821D was to defer action in your case. If ICE deferred action in your case under DACA, submit a copy of the approval order, notice or letter issued by ICE. You must complete Part 4. of the form indicating how your intended travel fits within 1 of the 3 purposes below. You must also provide evidence of your reason for travel outside of the United States including the dates of travel and the expected duration outside the United States. If your advance parole application is approved, the validity dates of your Advance Parole Document will be for the duration of the documented need for travel. Below are examples of acceptable evidence: Educational Purposes yada yada..."

 

You need ONE OF 2, 3, 4 OR 5, not all.

 

A K1 will comply with "2", "other evidence showing the circumstances that warrant issuance of an Advance Parole Document". 

 

The "other evidence" is the attached I485 application which entitles a K1 Visa Holder to routinely file an I131 for free concurrently with I485.

I agree. The VJ guides for I765 doesnt list every required document as outlined in the I765 Instructions and the I131 VJ Guide doesn't list anything at all.

If you have a joint sponsor (ie. a sponsor who does not live with the original sponsor and has filled out an I864) or a co-sponsor (ie. a sponsor who does live with the original sponsor and has filled out an I864a and has combined income with the original sponsor on their I864) then I would suggest distinguishing between what documents you submitted for each the sponsor, joint sponsor or co-sponsor and not combine the description as you have so it is clearly detailed what you have submitted for each person. You can name who the documents belong to for each person in the list to detail it further.
