Hello guys! hope someone here can enlighten me about our case.

 

My LPR husband petitioned me and our 4 children under F2A with details mentioned below:

Priority date: February 29 2016

Petition Approval Date: June 25, 2016

Visa Became Available: March 1, 2018

 

Everything's going smoothly for me and our 3 other children except our eldest. I received a notice saying that she was moved to F2B from F2A category because she aged out. Her birthday is April 26, 1995. Can CSPA be applied on her case? What if my husband will file for US citizenship, as he's already 8-year LPR, will this help expedite our daughter's case if he will upgrade my daughter's petition from F2B to Immediate Relative? I'm really confused and worried, please help. Appreciate y'all. Thank you.

hi, nope she won't be an immediate relative, because her biological father, your husband would have had to been a USC before she turned 21. since she already is over 21, she would change category from F2B to F1, unmarried children over 21 of a USC, having years to wait.

  • After applied CSPA to her case, she is still over 21 years old (she was almost 23 years-old when Visa became available and she could only reduce 4 months from the date her case was received until it got approved by USCIS) .
