Hi All! I have an interesting question.

 

What if I already did my first entry to the United States with an immigrant visa on my Philippine passport on a border between US/Canada and I go back to Canada let's say 1 month after entering US to take my oath to be a canadian citizen but what if I’m still waiting for the green card that time. Technically, when I take the oath to be a canadian citizen my Philippine passport will be revoked because I will lose my Philippine citizenship (but I could reacquire back dual philippine citizenship through a process that could take 1 month). When I enter back to the US via border with the new canadian passport will there be a problem because the temporary I-551 immigrant visa is on the revoked Philippine passport and I don’t have the physical green card yet?

 

*short back story: I lived in canada for more than 5 years as a Permanent resident that made me eligible to apply for canadian citizenship so I applied for personal reasons and because why not. Then I got a good paying job in the US that sponsored me for eb3 )

 

Hope you can share your insights on this scenario.

While your Philippines passport is no longer valid, it will still be in your possession and you show it along with the new passport at entry

Thank you for your reply. I was just scared of being questioned at the border If I no longer hold a valid Philippine passport. But you're right I already have the new Canadian Passport.

You may want to double check with the embassy first. The state department website says both passports have to be from the same country if one needs to travel with a new valid passport using a valid visa from the old passport.

Do you think I should disclose the issue with the philippine passport to the border agent after showing both passports? I don't think canada will inform philippines that I took the canadian citizenship for the philippines to cancel the passport technically.

Yes.  Just show both passports.  Not that it matters but the CBP will not even know about the invalidity of you PI passport

Thanks, different topic but hope you have any insight. When I entered US as a new canadian citizenship should I update USCIS about the change in citizenship.  I checked Form I-90 that you have to complete that if there's any changes to your status like name or civil status but nowhere there a section to update in case you changed citizenship. Any thoughts?

They are only concerned about US status and US addresses.
