Urgent info needed

Good Day guys my wife is filing a I 130 petition on my behalf but apart of the proof of bonafide marriage is to submit conversational proof whether phone call, whatsapp, facetime etc. At this point her phone has been defunct hence she doesn't have those proof. However i have all the conversations that we been having over a prolonged period. Is it admissible for me to send those to her which will be sent to the USCIS? She is getting nervous about the situation. Can i have some feedback please and thanks.

It does not matter if it comes from her or your account - they should be weighted same.

Just provide a marriage certificate, nothing more is needed, if it is needed they will request it. These evidence are more important at the embassy interview, hopefully you have marriage photos/album etc.

Don’t just focus on call logs or chats, you two could have other forms of evidences too that can be submitted. Read thru guidelines in this forum or i130 instructions. Provide as much evidences as possible to USCIS.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

The above is extremely bad advice.  No reason to explain why, really.

Everyone frontload the case except this guy.  Horrible advice.  

 

It's best to frontload a case.  It's best to submit more than just the marriage certificate.  It's best to submit the evidence of a bona fide marriage when submitting the I-130.  

 

"If they needed they will request it."  Yes, brilliant, guarantee an RFE to delay the case.

 

"These evidence are more important at the embassy interview."  BS.  The CO does not have to look at anything brought to the interview, but must consider evidence submitted PRIOR to the interview.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

While we do want to prevent RFE's, that is not the primary reason for providing sufficient evidence of a bona fide relationship.  Getting a petition approved is the easy part, usually.  The reason for front loading is so that the Consular Officer making the ultimate decision, MUST consider ALL that is in the file.  They are NOT required to consider anything brought to the interview unless THEY ask for it.  USCIS issues RFE's, yes, but they DO NOT ISSUE VISAS.  Chasing visas here.  Everything EXTRA is for the Consular Officer NOT USCIS.
