Hellooo

On march 18 a got a rfe from uscis asking me for my tax return, im doing adjustment of status for my husband, but i make a mistake on my taxes and i filled it out as single, i did an amended from single to filling jointly, when i did the amended the account person give me a copy of the amended and a copy like the original transcript. My question is can i send the transcript the he gave me or i have to wait for the irs processed it ?

Question: What did you originally submit with your AOS application: A copy of your complete return showing single status or a IRS transcript showing the same, or nothing? In order to be able to better answer your question, I'm trying to understand why you got a RFE in the first place.

Hi, I got an RFE because i didn't send proof of my taxes because i used  my bothers as a first join sponsor, i dind't know i have to send mine too, that was the only thing that i miss in the aos package... Then i fill out my taxes as single but i did an amended to my taxes and change that, i haven't send anything yet because i don't know if i can send the transcript the accounter person gave me after he did the amended, The one that he gave have my marrital status as Married filling jointly, So i want to know if i can send the proof to uscis with those trancript.

OK. I've got more questions. Which year's taxes are you talking about, and in what year did you marry your husband?

 

The transcript that the tax preparer gave you will mean nothing to USCIS. They want an official transcript from the IRS, which will not be available until after the IRS processes your amended return. As an alternative, USCIS will accept a copy of your amended return, but it must be the entire return including the 1040 form, w-2's, 1099, schedules, etc. (everything you submitted to the IRS, not just the 1040 or W-2, like some people try to submit). I asked the question above about the year you were married to determine if you even needed to amend your single return.

IMO You have two options, depending on the RFE deadline. If you can, either submit a copy of the entire amended return, or wait until it is processed, request an official transcript, and submit that. Now, if the RFE deadline is soon, and you can't wait for the amended transcript, you can submit a transcript (or complete return) that you filed as single. That should at least satisfy the RFE. You could include a cover letter explaining that you have filed an amended return to change status to MFJ, but that it is still being processed and a transcript is not yet available. Then bring the transcript of the amended return to your interview.

I personally do not know, but a google search result from intuit mentions 13 weeks!

another question do i have to send the affidavit the join sponsor again. because i put him as first join sponsor, i think now i will be the first join sponsor and he will be the second join sponsor

I haven't been in a similar situation, so I can't know for sure. You're on the right track that you are the first sponsor regardless of your income, and you will have a joint sponser, but I do not know the forms involved in joint sponsorship. So that your question can be seen by more people on VJ, I suggest you post that question separately in one of the Adjustment of Status from forums.

Your brother is the FIRST joint sponsor.

You are not a joint sponsor. You are the primary sponsor.

Hello Maria,

 

How it ended up with the "single status" and your amended return? Did USCIS ask questions about the wrong status in the tax return? Did you send them a copy of your amended return? Did they accept it?

 

I'm asking because I'm in a quite similar application. The only difference is: I'm an H1-B holder and my wife is H4. Filing my taxes for some past year I checked "single" (I got bad tax advice). I sent my amended a couple of months ago but due to COVID-19, its processing takes ages for now. I'm about to submit I-485 for me and my wife. I'm nervous and a little scared because I'm pretty sure that IRS won't complete the processing of my amended return in time...

The IRS does not actually amend transcripts. They will always show what you originally filed. Send what you have. They want to see how much money you make and your spouse/sponsors pledge to support you. They aren’t auditing whether you filed correctly.
