Greetings !

 

My inquiry is about the time frame for filing AOS application. My fiance' arrived in Feb. We got married in March and his visa expires within the first two weeks of May. I am wondering it is absolutely necessary for me to file AOS before the visa expiration date? I have had some unexpected expenses and I do not have the extra money at this time.

As many many others have been told, while as long as marry within the 90 days, you can technically file for AOS years later and still have no issues. Most people end up filing a few days after the 90 days, and no issues... that being said, once the i-94 expires, he is out of status and eligible to be detained and even deported. Just being married to you means nothing really. Plus, he will just be sitting around doing nothing since he won't be able to work. This is why all these expenses should be preplanned and money set aside to avoid this issue.

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

There are really no benefits to delaying........if at all possible, I would file.......but I agree with @Ben&Zian

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Also might want to consider that a delay in filing will result in a delay in your spouse being able to work and contribute to the household income.

Wow.. thank you in that case it will definitely be before the i94 expiration
