Hi there,

 

I was reading in another group that it was NOT a good idea for the petitioner to file the D160 from their computer since technically the beneficiary is supposed to apply. But there is a language barrier so I know some petitioners do it for their fiances but that there may be an issue as they can find out from IP address. Anyone have anything to share about this? Where does it say “beneficiary is supposed to fill the form”?

 

It’s exactly the opposite. It says “if the applicant has problem filling DS 160 or 260 or any other forms, use third party”. That 3rd prty could be anyone including the petitioner.

Can confirm that IP addresses can certainly identify the country from which the form was sent, but I can't imagine they really go that in depth.

What is the basis of this other group's position that it is not a good idea?

There is a box on the signature page to indicate a preparer. Use that.

  • No issue - many petitioners did this, including me (for DS-260), I was just on the phone with my wife when we were working on DS-260 and I declared myself as preparer.
  • People can use VPN, can remote, etc. They probably do keep track of login IP but for security purpose.

Yes that it should be the beneficiary as a few were told by their lawyers not to do that.
