Looking to expedite AP due to terminal family member, but how will it affect AOS?

Hi, I am going to go to my local USCIS office in Manhattan and ask to expedite my AP as sadly my grandmother in Northern Ireland is terminally ill and doesn't have long. I asked my dad to get a letter from the doctor (which was difficult due to the UK data protection laws) and I have been sent a copy of a letter saying that my grandmother is expected to pass away in the coming days/weeks.  I think i should try and go back to see her, or be able to attend the funeral with my parents but none of us want this to affect my AOS application. My questions are these;

 

1) Is a letter from my grandmother's doctor and my NOA for AOS and AP enough evidence for expediting my AP? Do I need to bring anything else to the USCIS office? The letter only states that a member of my family has a terminal illness - it doesn't say her name or relation to me (those data protection laws I mentioned).

 

2) How will this affect my AOS application? (and my EAD application being processed at the same time?)

You can request an expedite through USCIS. Yes provide all evidence you can with it. They may or may not approve it, there is no guarantee of it.

 

As to how would it affect your AOS, it shouldn't have any affect.

First, I think you are looking for emergency AP, not an expedite. These are different - an expedited AP request still has to go through the normal review, approval, mailing process. Emergency AP can be issued on the spot.

 

1) I would suggest providing any other additional evidence you have on you showing that you have a strong relationship with your grandmother, her medical condition, etc. Even if they aren't official documents from the doctor, I'm assuming there's something your grandmother (or local family or medical advocate) can obtain on their own.

Nobody knows what would be enough to convince them, but try to be overprepared IMO.

 

2) Emergency AP is separate from the existing EAD or AP applications pending. No impact.

Only issue I see is the vague reference to a member of the family which could mean anything, but if that is all you can get go with it.

Thanks. Do you think writing a short cover letter to give with the letter from the doctor would help - I can explain who the family member is, more about her medical condition etc.
