Visiting Visa While IR1-CR1 Is Pending

I lost my tourist VISA last year for a 4 day overstay (my fault, so stupid, ugh)  After months I re applied, got all my paperwork together (proof of income, ties to my country etc)  and got turned down for, you guessed it, the overstay. :( Lesson learned! I can't afford to keep trying and we're starting the CR-1anyway. After reading all the cases of people being denied entry for a pending immigration process, I don't think my heart would be able to take it!

➺ 02/08/17 Case Assigned to USCIS Nebraska, sigh. 

➺ 02/13/17 We got our NOA1! PD: February 8th 

➺ 12/15/17 NOA2 finally! after 10 1/2 months. 

➺ 12/21/17 NVC confirmed they received our file 

➺ 01/22/18 Documents sent to Rapidvisa 

➺ 02/05/18  NVC received our package 

03/15/18 Case complete! 

06/27/18  We got our Interview date! August 28th 

08/30/18 The package arrived (waited at Juarez)

08/31/18 Entered the U.S with my husband 

➺ 02/13/19 Husband confesses he cheated, leaves

➺ 02/16/19 Husband decides to abandon the marriage

➺ 05/13/19  I am officially divorced. 

 ➺ 07/03/20  I file to remove conditions on my own     

 ➺ 08/13/21 I finally get my biometrics appointment 

➺ 02/26/22 I got my interview assigned: March 31st.

There are about 3 reports, as far as I know, in total on VJ for people being denied entry, and only 1 of them is at the Airport. So, I don't see why you say all those "reports". There is, generally no problem visiting during the period of the petition.

I know it's not impossible, it's case to case. In mine, it would be nearly impossible to provide the required documentation/proof of ties. I'm talking also outside of the forums, since I have read/heard from many other families :)

You should start CR1 application now.

I just got back from my visit from the States. We are currently at the NVC Stage. I did get questioned alot at POE (Seattle) from the CBP Lady. Some people say that while you are at the NVC stage they can see you have a pending Application on the Screen. I do not think it is true. The only reason she knew i was married is because on my ESTA Application you have to fill in the Adress where you are staying. Of course i put down my husbands Adress and she looked at that and saw two matching last names, then she started asking me about my husband. 

I brought all the ties to my country but none of it was needed. She just grilled me with questions. The way she asked me, i felt like i was violating the law. None or less, i got through and left the day i was intending to leave. 

They also asked me why i am flying to the US at the Check in Counter of the Airline i was flying with. 

I asked her why it was relevant (just to see what she would say) and she told me that they have to ask that but since i said 'visiting family' and i don't look 'suspicious (bringing multiple Bags and Suitcases- i only brought one and a backpack for carry on) i was fine. She did make sure i had a return ticket.

Last time i visited was last christmas. I hate flying, so i try to make my husband come over here. The CBP Lady also asked me how many bags i have with me. So i advise everyone to not bring a lot of luggage so it does not look like you are moving. I only went over there for three weeks over the holidays, so not long. I was horrified of going because i was so scared they would turn me down. It was not a pleasant ride with the CBP Lady so be prepared for anything.

If you have not already filed any legal paperwork for an immigrant visa, she should be able to enter the states and then you file for the AOS.

 

my husband and I married in July 2016 on his k1 visa. Unfortunately we were given wrong information and told he could return to Australia and finish his work contract and then we could file his paperwork. 

Unfortunately, when he attempted to return to the states on his ESTA, he was denied because he already had a green card application started. 

 

So so that is when we began the CR1 process and he is not allowed to visit again until it is completed ?

 

I see that most people are able to visit without difficulty, however that is not always the case. And now we must go months without seeing each other......so if that can be avoided, I would!

Recent service request has told us that my security check up is pending. I have a 10 year visitor visa to USA.  I wanted to know if it will be ok if I visit USA on pending visitor visa. It's quiet urgent for me to see my husband as he has lost his father last week.

please suggest.

Timeline

Processing your green card will add additional scrutiny, but you can try and visit. Based on reports here, there is a 99% chance they let you in if you use your visa as intended and you follow all laws of a non immigrant visa.

How far along are you in the process; Timeline needs updating? 

You can try to visit, though entry will be up to the CBP.

Has anyone been denied entrance once and tried again with any success?

my husband tries to visit last October and was denied, he is from Australia.

 

i want him to try again but it is an extremely expensive chance to take....just wanting some advice....
