Anyone from Mexico with a pending I-130 Petition try to enter with a B2 to visit a spouse?

I will be visiting my husband for 2months. Have my Noa2, just worried. Hope not denied because im from India. Visited once in 2014 before wedding. Just want to spend 1st wedding anniversary and his graduation. Having return tickets,admission letter,fee receipts , bonafide certificate as im in college. Do i need anything more? Is 2 months a problem?

If you are married you cannot get a K-1.

Most likely if he's applying after the immigrant visa is pending, high chance it will be denied ?

Applying for a tourist visa during the immigration process doesn't affect the i-129/-130. I doubt they'll approve the tourist visa but if you have the money for it, you might as well give it a try.

Hey guys,

So I'm a US citizen and live in Brazil with my wife... I applied for the CR-1 in february... we were able to get through immigration with no problem. I waited in line and we entered together. The airport was SFO (san francisco). The officer asked if we lived in Brazil and what was the purpose of our visit and how long we would be staying. Nothing else. We told him leisure and six weeks.

By the way, we brought a bunch of proof of her ties to Brazil. I just left a job and she is unemployed. She has an apartment, a car. I also brought proof of recently paid utility bills of the house we live in. We also have a ticket bought for a trip around south america in late May. We didnt have to use any of this,

Great! Did you talk to them about the CR-1 at all? What kind of visa did your wife have? My friends in Brazil have had more trouble getting the visa in the first place--not at POE--and none of them have even been married to USC... they can really be sticklers at the consulates there for handing out tourist visas.

I arrived here in US one week before on my B1/B2 visa. I will be staying for 2months. POE officer was very nice and just asked how long i will be staying and what me and my husband does. That was it.

Before I moved to the US, I lived close to the US border (in Canada) and drove across almost every weekend while my CR1 application was pending. I never faced any issues at all, but I have a friend in a similar situation who DID face huge issues and was prohibited from crossing the entire time her application was pending.

I think the difference is that she did not have stable employment in Canada and did not own a property or have a rental agreement (lived with parents) so she could have easily disappeared into the US whereas I had more ties to Canada than she did. Just wanted to share that although we had two similar situations and were applying at the same time, I was always able to cross into the US but she was not.
