I wish i will be able to enter. But does anyone have any idea. What if your NOA 1 is rejected like for improperly filed or some other teason. Will then too you can entre USA without any hassle???

CBP doesn't know whether a petition has been filed or not. It's not something they can see in their system. CBP can only see that you're in the visa process once you submit the actual visa application, the DS-260, which is the first time the beneficiary actually puts down his or her passport details. So your NOA1, RFE etc will not affect your ability to enter the US as a tourist.

Unfortunately, no one can tell you whether you'll be able to enter the US hassle free or not, that's at the discretion of the CBP officer at your point of entry. Only one way to find out though.

Hi guys I would like to share my experience so far with y'all.

My husband & I are in the CR1 process. Currently waiting for an approval of I-130 petition. As many of you we have been apart for the time being with me living in the UAE where I currently live & work.

I work as a cabin crew for one of the airlines and I hold crew visa + B1/B2 visa. I got my tourist visa at least a year prior to applying for CR1.

I travel to the United States every month (2 - 3 times a month) as a crew and once a month or every other month as a tourist.

So far I have gone visit my husband 4 times - JUNE, JULY, SEPTEMBER and NOVEMBER. We got engaged in JULY and married in September.

JUNE - I entered via Chicago (ORD) - stayed 6 days. No questions asked at all.

JULY - I entered via Seattle (SEA) because I was going to Hawaii to see my husband's parents and him of course. I was questioned quite a bit. I was going there for 10 days. The officer was asking me: Where am I going, why am I going there, how do I know these people etc. Then I explained him that I have lived in the United States for two years. He said that it explains why I have a lot of connections in there. In the end he was nice (not at the beginning tho) and said he is letting me go because he knows I won't stay and that the only reason why he is being easy on me is because of me being a cabin crew. ANYWAY, passport was stamped and I was free to go.

September - Entered again via ORD. - I told the officer I am going to visit my fiancee (at the time) and that we are going to a military ball. I showed him a letter written by my husband with the invitation to the ball. He was reading it and we ended up friendly chat for couple of minutes while he was asking me about my travels around the world etc. Really nice guy. Turned out he was originally from Europe.

November - Entered via Dallas, TX (DFW). - Handed my passport and the immigration form to the officer. He asked why am I coming. I said to visit my husband. He looked at the paper, looked back at me and asked me if my husband is in the military. I said Yes, Sir. He asked what branch. I answered. Then he asked for how long am I coming for ... I told him I have a leave at least till the end of November and then it depends on my roster (I ended up leaving in December). This whole thing took about 2 minutes maybe even less. Most of it was a friendly chat. At first I was scared because he was not smiling at anyone who was in his line. When I came, said politely and cheerfully Good morning and gave him a smile, he smiled back and he was more approachable than what I have observed before.

So far I was not given much of a hard time.

Now I am going back to the United States however I will be leaving work and THE UAE so I can spend more time with my husband due to his upcoming deployment. So obviously I am a bit worried. At the same time I have had a chance to chat with multiple immigration officers while I was entering as a crew. One of them told me, that I have nothing to worry about since I am doing everything LEGALLY and that doing CR1 is a right path. Another one told me that they DON'T SEE in their system pending CR1 - not sure if that is true or not. And another one said that they are either way looking for A. A bad guys or B. People that might have illegal intentions ... So I think as long as you are doing everything LEGALLY, being HONEST and have GOOD intentions, you should be ok.
Yes, of course it depends on a day and who you are dealing with. But at the same time I really believe that honesty is the best policy.

I am now preparing my documents - make sure that I have a marriage certificate with me, copy of NOA1, letter from my husband and any supporting evidence that I have no intention to immigrate. Hopefully will be fine.

In november u entered dallas handed my passport and immigration papers?.... what kind of papers you were not working by this time on your cr1... and yes they see that u are working on a cr-1 as soon as you file your ds-260 form at the nvc

Yes, but apparently it doesnt show until then. Thats What I was told by him. And since we are stuck at Nebraska (since we Dont have orders yet to expedite) we are still waiting on approval. :)

Thats a customs form what u mean thats if you carry any items that could be illigal or dangerous for the usa.

And if you have anything to declare in your belongings.

Yes they dont see anything till you are registrated at the nvc (national visa center)

Make sure you got ties with you that u leave the country then there is not problem.

I have my case at the nvc now and i am at the moment in the usa for 5 weeks.

And they asked again if i had ties!

So i had my whole map with me with all the copies and original paperwork from the uscis as well of the nvc with me and i had no problem.

Sorry my bad. We use at work terms from immigration form, custom form for blue paper ? so I am sorry for bringing my bad habits here. :))))

Yup. I am preparing to have everything with me. Better be safe than sorry. Will see how it goes. I am taking quite a big risk tho. I have to leave my job in order to spend some time with my husband. At the same time it's worth it because this is the only time we can be together for couple of weeks.

Question:

Attorney advised us that for my husband ( beneficiary & UK citizen ) to enter the US while his K3 with I-130 is being processed is considered fraud because you can't come in on a different visa while one is processing. Any truth to this? Thoughts?

Not true!! K-3 visa was used back in the day when the CR-1 visa process took about 2 years and was mainly invented in order to shorten the separation between the wife and the husband. Now the CR-1 visa takes about 10 months considering there is no RFE's or nothing.

If you have a B2 visa or choose to apply for one, make sure to address that you have a wife/husband in the U.S and that you will come back to your home country after your short visit

Well i have a question to ask. Im from India and after getting married i issued a new passport with my husband's name. But my old passport has B1/B2 visa which is valid for 10yrs but obviously doesn't contain my husband's title. Will that be a problem if i travel to my husband for a few days because my tourist visa doesn't contain my husband's title... I kpt my maiden name n husband's title both now. Please help.

Well i have a question to ask. Im from India and after getting married i issued a new passport with my husband's name. But my old passport has B1/B2 visa which is valid for 10yrs but obviously doesn't contain my husband's title. Will that be a problem if i travel to my husband for a few days because my tourist visa doesn't contain my husband's title... I kpt my maiden name n husband's title both now. Please help.

Never had a problem traveling on B2 to see my husband. I kept my maiden name until I can change it legally. I have a copy of our marriage certificate on me. I think You can carry two passports and bring along your marriage certificate. Correct me if I am wrong

Never had a problem traveling on B2 to see my husband. I kept my maiden name until I can change it legally. I have a copy of our marriage certificate on me. I think You can carry two passports and bring along your marriage certificate. Correct me if I am wrong

Does anyone has any idea wt should an university should hold as an evidence that i will come back to my country beside the bonafide certificate and return ticket? I have no job. If any idea please help.

I spoke to immigration officers. They advised me to bring anything, anything that could help. I was told to bring a letter from my husband and if I can even his commander because I am quitting my job due to my husband's pending deployment. + You can bring along The NOA1 or any paperwork regards to your visa.

Thank you. I have no paper work but my husband has everything but can bring a copy of noa1 with me and don't know what you mean by letter from husband. I wanna attend his graduation too, maybe i can show his i card and the graduation invitation too and my all college tution fees receipts and id card and acceptance letter too. Hopefully there womt be any problem because honestly have no intention to stay back because i will be graduating this year too. ?

So if it's possible to visit the US while your application pending, that means they don't cancel the Tourist Visa when you file the I-130? The office translating our documents into English mentioned to us that my wife's 10-year visa would be canceled once we submitted the I-130. (That office is also an agent for visa applicants, but we're using them just for translation.) My wife has kept a 10-year Tourist Visa in her passport for a couple of decades now. Hate to see that canceled until we have a firm Immigrant Visa.
