Visiting Visa While IR1-CR1 Is Pending

We recently got married in Pakistan and will be applying for our CR1 as soon as the documents are translated, etc. After we file, is there any way my husband could get a visitor visa to come here? My brother has some severe health issues, including MD and heart problems, and I would love for him to meet my husband sooner than later. My husband has 2 businesses in Pakistan, a house, kids, etc., so he has many ties there.

Would we just be wasting our money? Thanks for the info.

The chances of him being granted a tourist visa is less than 50%. Having a US Citizens spouse essentially supersedes any ties an applicant may have to their own country.

There is no such thing where tourist visas are concerned.

They have a medical emergency in the family so if they apply for cr1 they might can get prefferred proccessing

Yes; however, actual admission to the USA is at the discretion of CBP and there is no guarantee that you will be granted admission. Carry proof of your ties to India in the event they are asked for.

Doesnt mean that the visa i applied for(CR1), will be or can be rejected or cancelled anyhow because i will be travelling while its in process?

Thanks alot. I have another question,will it be a problem if I stay like 1 and half months like 7 weeks or maximum 2 months? And right now i have no job but Im a full time masters student in a university. What kind of ties can i show that I will return to my country except letter from university and Im living with my parents.

She used the 90 VWP and had no problem coming through (well except I forgot to tell her to fill out the declarations form and she had to spend an hour waiting for someone to help her figure out what to do).

We have our fingers crossed that the NVC will hurry up with our application and she can have an interview and then come right back. If the NVC ends up taking a lot of time, I may have her fly back and stay for another 90 days. My main concern about her coming back is that she speaks almost no English and panics really easily. If they started asking her serious questions, she would just freeze up.

But besides that issue, going back and forth on VWP isn't a big deal right?

Question:

Attorney advised us that for my husband ( beneficiary & UK citizen ) to enter the US while his K3 with I-130 is being processed is considered fraud because you can't come in on a different visa while one is processing. Any truth to this? Thoughts?

No! This is not true. I had a pending K3 case when I came to the USA on a tourist visa. You just have to be very honest about it and have all the documents with you when you entering the country.

Well it is true by usa law.

But because u are working legal on getting a us visa for immigrant they are not so hard in it.

They let u in if you have ties with you that you really are planning to exit the country in the time u are saying u are. If they have any doubts they can deny your entry to the usa.

So make sure you have ties with you to show you are working on a legal way to enter the country in the future, and that u for now stay short term just to spent some time with your partner.
