Visiting Visa While IR1-CR1 Is Pending

Hmm

I am not sure what the limit is for length of stay, but i have been told by border officers before that the combined number of days spent in the US must not exceed 6 months.

The fact that she will have a round trip ticket, along with the knowledge that she has to return to Canada for her medical and Interview should be supportive enough.

Also, proof of Ties in Canada like recent letter from employer or copy of lease/rental agreement will help.

I wouldn't come right out and say she's just going to wait out the process.. but say she wants to visit and be there to help you with your home purchase and plans on returning.

They have also told me before that i should not start bringing over any personal property in preparation for moving. So i always bring what i need and then bring it back to Canada.

Obv your wife can bring more stuff since she intends on staying longer, but it should just be personal belongings, nothing that will make them think she's already starting to move

Thank you for the response... Her visit would not exceed 6 months. I am assuming it would be 2-3 months at the most... as per our timeline, she will need to return to Canada for her medical and interview. She would have all of her I-130 information to show her intention to return to Canada. She can show proof of employment and an apartment lease.

She will also not be bringing any belongings other than clothing to stay... So that would not be an issue.

i came back from US. Had no problems, they asked me questions they usually ask. I travel with two passport since I've changed my name, so visa is in my old passport. I asked does he need my marriage cert. he said no need, but it's good to have with me

  1. purpuse of travel bussines or pleasure -> pleasure
  2. Where are you going -> Visit my Husband
  3. where are you staying ? and the address - so I asked him does he wana know all address or just the one where I will mostly stay, since hubby and I will travel a bit while I'm there...he just wanted to know my husbands address and I think his phone number
  4. How long will you be here - 3,5 weeks, gave him the exact days
  5. he asked are we in a process, I sad we are.
  6. Asked for NOA2 - gave him email, explained my husband had orginal, he said this is fine
  7. I asked him about next time..POE he explained and explained regulations regard the dog etc..

it was a pleasent talk and less than 5 min

I had a tourist visa (B1/B2) before we started process, never overstayed, always left when I said I will...

I applied for a visiting visa to see my ill husband in the States . but I denied the visa stating that my ties in America are much stronger than my ties here

I just came back from the states after 5 weeks of stay, i was sceptical but ones i landed and whent to security i sayed im here to visit my husband and that i stay for 5 weeks i had a esta and i told him also rightaway that i have an i130 pending and showed him the noa1 he looked at it and sayd well dont come to much and youll be fine have a great stay in the usa.

That was it, i friendly sayed a thank you officer and walked into the usa :)

So to them who are afreigd dont worry just make sure u have a return ticket and your noa 1 with you and youll be fine.

October 05 2015 I-130 approved at california

october 09 2015 noa 2 in the mail

Going for a B1/B2 visa on tuesday, My company is sponsoring as I am key point of Contact for a lot of clients. and will be meeting them up to expand and do more business. My file was sent to the NVC a couple of days back, any comments on chances ?

I am feeling very positive about it as my intention is to just visit and come back ....

Hi everyone, i have already posted this in another thread and i was suggested to come over here.

I am an italian citizen and i am married with a US citizen and we are living in Italy. We have a 1 year son and he has already the US passport.

My wife has just filed the I-130 at the US embassy in Rome and they have received it.

In september i ll have to travel to US for a 5 days vacation without my wife and my son.

Will i be ok with the ESTA application that i already have or i must file for a B1/B2 visa??

I was reading that it is sufficient that i show my intent to come back after the vacation and i think the fact that my wife and son stay at home should be enough.

Can i kindly ask for any suggestion??

I have travelled twice since submitting the i130 on the esta, my husband lives in the States. I had no issues going through US immigration in Dublin.

What are my chances, wife is in the US, I have not applied for IR1 and definitely not going to lie on D160. I want to visit my uncle in another sate and also see wife in another state before retuning back.

Slim to none.

Can we travel to US as a visitor while the waiver is on process??

In your specific case, no because you are currently inadmissible.

No, just the opposite. In that situation, your odds go down to nil.

I'm from the Philippines and have married a USC in January 2015. I have a tourist visa and have been in the US twice (in 2013 for three weeks for business travel and in 2014 for a month when his father died). I have a job in my country. My husband works as an army contractor and would be in vacation by December for maybe a month. We have not filed yet the application for the GC, hopefully we could by this month. Need your advice please what my chances are in getting through the POE to visit my husband when he goes on vacation. Thanks in advance.
