Delaying Immigration Process at NVC Stage

Hello all!

 

So far you guys have helped me out a lot regarding the immigration process and I have another question for you.

 

My wife's I-130 has been approved and we have reached the NVC stage. However, we are not looking to immigrate to the US until July/August 2020. We are located outside of the US and I do not have enough vacation days to stay in the US to apply for the reentry permit.

 

How can I delay the process such that I can get as much done with NVC while delaying the process? I am worried about the possibility of my wife going through administrative processing because of her nationality.

 

I want to get as far as possible with the NVC process while getting to the final step in which I can delay. 

 

Can anybody propose a solution to this problem?

Keep in mind that medical expires in 6 months so you probably can do this but if you delay the interview for a year you may have the petition terminated.  I think all you have to do is keep contacting the Embassy and NVC to keep the petition active but you also have the medical to deal with.  POE must take place while the medical is active. If you put off your interview and medical for a year will you still be able to prove domicile?

 

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Since the medical is done AFTER NVC, and the OP is asking about the NVC stage, the above doesn't really address the OP's question directly.  While at NVC, there is no reason to contact the Consulate.  Decide when you want the interview to occur.  Then back up from that point and delay at NVC.  Just don't respond for a few months.  Then after you do, don't take the next step for up to a year.  Do your math and provide NVC the final papers, about three months before you want the interview.  Just don't go more than a year without at least contacting NVC.  

 

If you time it wrong and your wife has an unpredictably long AP, you have no way around that.

 

The medical, is done just before the interview, AFTER NVC.  Visa will be good for six months after the medical but, in cases of lengthy AP after interview the visa could be issued MORE than six months after the medical.  What happens in those cases as far as visa validity, is outside my area of knowledge.

Timeline

i had the same situation, we finished NVC process and my file waz sent to Usa embassy in Kiev, interview scheduled, and at that time i got pregnant and we decided against going back to usa. I canceled interview and wvery 6 month i write to the embassy with request to keep my case updated. I was told at the Embassy i can do it as long as i want provided i contact them every 6 month. I don't know if every embassy can do it but i am postponing it for the last 3 years
