I have a question! My wife's K1 visa on her passport expires on the 8th of august. We entered the USA on the 9th of March this month. My question is how long do we have to file the papers for change of status? Is it 90 days from the entry or does she have until the date expires on her passport for the k1?

She entered on her K1 visa, and you got married? And now you´re gonna file your AOS. I didn´t read any time limits for this, but I think that her K1 visa expiration date is about before the wedding only, after the wedding she´s no longer an illegal, just as long and you guys don´t let it pass too many months from the wedding to file for AOS. I heard of people filing it after 6 months.

Read item 9 from form I-129F.

It explains what you have to do (to apply for conditional permanent resident status):

"9. How Does Your Alien Fiancé(e) Obtain Permanent Resident Status?

Your alien fiancé(e) may apply for conditional permanentresident status after you have entered into a valid marriage to each other within 90 days of your fiancé(e)'s entry into the United States. Your alien spouse should then apply promptly to UCIS for adjustment of status to conditional permanent resident, using Form I-485,Application to Register or Adjust Status."

and later, item 10:

"10. How Does Your Spouse Become a Permanent Resident Without Conditions?

Both you and your conditional permanent resident spouse are required to file a petition, Form I-751, Petition to Remove the Conditions on Residence, during the 90-day period immediately before the second anniversary of the date your alien spouse was granted conditional permanent residence. Children who were admitted as conditional permanent residents with your spouse may be included inthejoint petition to remove the conditions.

The rights, privileges, responsibilities and duties that apply to all other permanent residents apply equally to a conditional permanent resident to file petitions on behalf of qualifying relatives, or to reside permanently in theUnited States as an immigrant in accordance with the immigration laws."

it is advisable to apply for and submit your application for green card immediately after you are married. why wait? but if you must, be sure to send in your applications before K1 visa expires. once your K1 expires, it becomes difficult to get a driver's license or SS#.

12.17.07-check cleared my account, cashed on 12.13.07

09.09.05-day 010 (292): NOA's received

07.12.05-day 233: "JUST MARRIED!"

Ok, but anyone how long does promptly is? 'Cus for some couples the fees for the AOS are a bit too much to pay for right after having had marriage expenses.

I'll file asap, as I'll do a civil marriage only (my family won't be able to go for my wedding, so we're just doing it at the court, easy and cheap) and I'll have had saved for the AOS, but for some people who get big weddings and honeymoon to apply for the AOS can become a burden.

Any personal experiences on how long after the marriage you applied for the AOS?
