Processing Times (I-751) for MSC (National Benefits Center)

I didn't say you have it, I said you need to have it approved. But you can file N-400 while I-751 is pending, as long as you're eligible. You cannot skip I-751 and I don't understand your statement:

You don't have choice, you always need to pay both fees (I-751 and N-400) if you were given conditional green card.

approved is approved

 

and you just said my I751 needs to be approved before I filed for N400. Misinformations are just uncool.

 

My payment for I751 was for nothing since it takes 100 years to get a GreenCard. Why did I pay for that stuff then if I need to pay again for N400?

Please spend some time to understand how the process works. Information is readily available on this forum. Immigration benefit is a privilege, not a right.

You need I-751, because you have a conditional green card. You can not skip this. This is a MUST have

 

Whether or not to apply for N400 it is your DECISION. If you want to be a citizen and eligible you can apply for it.

What I was trying to say is that "approved" and "pending" are for me two different things. Can I apply for N400 even though my I751 is still pending? So, it's a yes.

 

I don't understand why USCIS takes money for I751, takes their sweet time, just so to take money for N400 again.

Yes, and I said you can apply / file for N-400 with pending I-751. But you gotta understand, N-400 cannot be approved without approved I-751.

 

Just like "pending" and "approved" are two different things,  "approved" and "apply" are two different things.

You have to pay the I-751 fees regardless of the wait, which could be 10 days or could be 4 years to get approved. Also, many people don't apply for N-400. But the I-751 is both for those who apply for N-400 and those who don't. These are the rules, no matter how we feel about them.

No worries, I'm glad we came to mutual understanding.

 

When you file N-400, it cannot get approved without I-751, so a lot of the times, USCIS will review and decide on your I-751 before arranging N-400 interview. Other times, they will have a combo interview for I-751 and N-400 and give you decision for both. And in some cases, they'll only interview you for N-400 and you'll keep waiting for I-751 decision to get N-400 approved. There's no way of knowing exactly how it will go.

 

But even in the worst case, you're saving time, because N-400 will be already done. So you naturalize faster because you didn't wait for I-751 to get approved to get started on N-400.

So technically it’s not it makes it any faster, but the n400 are a high priority petition and if you got to the point that your n400 interview is scheduled and your i751 is still pending, you will be facing one of those scenarios 


you will get a combo interview for both cases

 

your n400 interview will be rescheduled when the field office gets your i-751 so they can process it.


 

you can be ahead of the game and send a cover letter explaining that you have a pending i-751 and include a copy of your receipt notice with the n400 application 

 

immigration officer will conduct the n400 interview but you will be told that they cannot make a decision due to a pending i751 and you will be waiting for the service center to snail mail your i751 along with your entire A-File

Yes, you can upload documents online for N-400, including a cover letter in Word / PDF document asking for combo interview.

It may get processed faster or it may not. When you have both I-751 and N-400 and if they're not decided after 120 days after N-400 interview, you can sue USCIS with writ of mandamus to get the decision faster. This is usually prepared and filed by lawyers.

 

But in a lot of cases N-400 helps I-751 even without lawsuit. Some people on this forum waited for 4 years for I-751. And it got approved with N-400 after filing in less than 6 months.

You can file for naturalization while your I-751 is still processing (and no, you didn’t pay the I-751 fee for nothing because eventually your I-751 will be approved hopefully). 
And yes, you have to pay a seperate fee for the naturalization application because that is a new application.

Update: 3 years and 7 months later, my husband’s green card is finally being produced, 2 days after they received my updated packet per their RFE request.

 

I’m almost afraid to breathe…
