No not allowed, if you maintain that you are together in a bona fide marriage and you are not, you have already filed for divorce you would be subject to charge of misrepresentation which may prevent you from getting any immigrant benefit in the future.

You are eligible to switch to a i751 divorce waiver case at the interview as you have filed for divorce, and you should bring a letter to the interview requesting the USCIS officer convert your joint i751 case to an i751 waiver based on bona fide marriage ending in divroce. It is a good idea to make a request to convert your i751 case in writing at the interview.

 

Bring proof you have filed for divorce to the interview.

Bring updated proof of your bonafide marriage up to the point of separation from your spouse to the interview.

 

Yes you will get an RFE for a final divorce decree months later and will have months to reply.

Do not delay notifying USCIS of the change in status of your marriage. To be approved for i751 divorce waiver case you need a final divoce decree and proof that you entered into the marriage in good faith. USCIS returnly approves i751 divorce waiver cases with the divorce decree and good faith marriage proof.

But on Dec 9th I got an update that our interview had been scheduled. The mail notice just came in yesterday showing that the interview date is Jan 6th. I know I'm not eligible to switch to waiver at the moment because our final decree won't be available until June this year. My questions are: 
- Are we allow to proceed I751 joint petition process at the interview even if we filed for divorce ? My spouse agrees to show up at the interview with me. If not, what can happen?
- If USCIS happens to issue an RFE to me asking for decree, but there's no way I can provide my final decree within that 87 days, what would happen and what should I do?
- What evidences should I bring?

just sharing experience

I was divorce waive. My divorce was final at the time

they want to see your final divorce certificate, if not, provide the evidence that you applied, just tell them what is the progress now, honest is always the best

 

also talk to a lawyer will be helpful as well (I did have lawyer at the time, cos I was so worried, and my lawyer went to the interview with me as well)

2022/03/21: Case received, no biometrics required

2022/03/21: Online status change to Case is being Actively Reviewed by USCIS

2022/08/15: Interview was scheduled

For my N-400 application, they scheduled it on the 10th and I received the letter on the 18th, so about a week.

Timeline

Has anyone asked to reschedule an interview recently? My husbands case has been “ready to schedule interview” since Jan 2021 and nothing has changed although I see in my informed delivery there is a letter. I’m assuming it’s going to be an interview letter. We are booked to travel back to Egypt in 2 weeks. I had a feeling this was going to happen. Do they reschedule without problems or is it better to change our flights.

update…it is a 24 month extension letter. His green card expired in April of 2020 and got an 18 month extension letter. That expired in Oct so he got an extension stamp in his passport in Oct and now this came. Honestly I’m glad it was this because we didn’t want to postpone our trip. We haven’t been back in 4 yrs.

Soooo my status changed to “interview was scheduled” on December 8

On December 20th I received a letter from USCIS with a new, 24 month extension notice but nothing about an interview.

The weird thing is…the date on that extension is 12/14…so 5 days after an apparent interview was scheduled.

 

 

I tried calling USCIS but was unable to get through…assuming it’s because of the holidays…

 

This is really frustrating…did they really schedule an interview or did they just accidentally update it when they sent out that extension?! Who knows.

 

Any thoughts/ ideas are appreciated

A lot of us got that 12/14 extension letter with no status update so I’d be surprised that it is connected with the interview update.

Definitely keep calling them while you haven’t received the letter, wouldn’t want to miss the interview.

 

For reference, my N400 interview was scheduled on 12/10 and I got the physical letter 8 days later.

Emma should be able to transfer you to the live chat. It's usually easier and they seem to be capable of giving you basic information (eg what is in the correspondence that they have sent to you)

I just had an interview yesterday and it went all good.

The officer was super nice & much more easier interview what I had thought.

 

The questions on interview were;

Both full names, current address & DOB

How we met

When we engaged

When/where we married

When we started to live together

 

We have a child, so the officer looked our I-751 and said “you have an enough proof.”

 

It only takes 10 min (total 20 min includes security check & waiting time) , no additional documents required. Even I prepared thick documents & bunch of photos, the officer told me that he didn't need them. 

 

I know my case was one of the fastest…I feel so lucky.

Hope all your process move smooth.

Quick question - got my interview on 11th Jan and I want to know if my wife has to be there? I know with covid they say to come alone but surely my wife being there would be more beneficial. Anyone had their interview at Chatsworth, CA possibly who can attest to whether they just want you or both of you?

Oh just saw this after posting my question. Looks like you went to Chatsworth local office. Did your partner go with you or were you on your own? If your partner was with you, did they let them in? 

 

Thanks and congrats. I actually had the same interview date originally but we went back to the UK for the holidays. Really surprised we got our interviews scheduled so quickly.

My interview letter says nothing about that my spouse needs to come with me. Not even in the section ‘Who should come with you?’. Is that normal? He’s coming with me anyways but I thought that’s odd.

If you filled a joint petition with your spouse, they must attend.
