April 2019 I-130 Filers

Hello everyone,

We've received our Noa2, we've been approved

Our priority date is Apr 29 2019

Approval on Dec 17 2019

It says they're going to forward it to NVC.

The letter came from the Texas Service center.

The USCIS processing time in our case was right on the mark.

I'm the USC and my husband's the beneficiary.

We're in the USA currently.

We wrongly thought that we needed to have the petition approved first before we file for AOS so the I-130 was filed separately.

But we rectified this by submitting my husband's AoS this August.

We got an RFIE on late October that we responded to early this December.

After our case was updated online that they've received our response after a few days on Dec 19 it changed to our interview is now ready to be scheduled.

So far we haven't received the interview notification in the mail yet.

Since we're already in the USA should we expect anymore letters regarding the I-130?

Because on the letter we got it advises there might be additional instructions for the beneficiary. Do we need to go to a consul and such?

Or we just need to wait for the interview schedule?

Also we haven't received my husband's EAD yet 😕

What's up with that?

Hi,

same here. Mine was sent from Texas service center to NVC on November 15th. I haven't heard back yet too.

According to their page, as of 16-DEC-2019, they were working on cases that were received from USCIS on 15-NOV-2019.

Hi, anything yet?

Hi, anything yet?

Two days ago we have sent an email to NVC, because it was more than 40 days since we had been approved from USCIS.

Guess what? Today NVC has replied and we have a case number.

Unfortunately, they have misspelled my husband's family name and we are waiting for our lawyer's answer (it seems like a transcription error).

I think they have replied after our email,  @LIfiler17, have you tried the same?

Overall, it's good news.

Great news! Congrats. I haven’t sent anything yet.. we have a lawyer and I don’t want to do anything without checking with him first - in case he’s emailing them already. Plus it’s Xmas. If yours was done today mine should be within a week. If I don’t hear back I’ll try email them in early Jan. Thanks for letting me know.

once you get the case number, do you know how long it usually takes before they send everything to the consulate?

We also asked our lawyer, but he said we had to wait 2 months before sending the email. My husband and I decided to go ahead and send it anyway.

As per the NVC timing, I'm also searching for information but it seems like there is not a unique criteria. For example, the timing changes in case of missing documents, mistakes, and other unexpected events. Also,  we have noticed that mistake on our application, therefore we expect some delays.

I will keep you up-to-date.

Update. The link to the payment doesn't work with my Windows PC (I get "Server Error in '/CTRAC' Application"). But it works with my husband's computer (Mac). I see this is a common error, maybe someone will find my comment helpful.

Anyway, we have paid the fees.

Hi LIfiler17,

any news?

We are stuck because we have filed everything but my husband's family name on NVC's website is still misspelled. Our lawyer had already asked them to correct it, but nothing happened so far. Surely, it was a data entry mistake.

I'm waiting too. I paid the fees and am waiting for the forms to become available.  Hopefully can finish that up quickly. I'll keep you posted when I get an update.

Just wanted to drop by with a quick update on our case - We sent in the new passport photos and got notice yesterday Jan 6th that they had received the requested evidence and will update us soon on it's acceptance or denial.

Just curious if there is an average time this could take for a simple REF.

Best wishes and Happy New Year to all!

Have you made any progress yet? I got my email from NVC on 12/27 and my lawyer has done nothing. I gave him all my materials in advance. I’m extremely frustrated. What is an appropriate time frame for a lawyer to submit the materials? I feel like 3 weeks is too long and unacceptable / every week is a week I could be with my family in the USA.
