Seriously, and I say so  because I had no idea that the I-129F form gave you a slight chance of getting approved faster with your spousal or fiance visa petition. Of course I found this out through reading threads on here and calling the USCIS directly and confirming this Wednesday. My "lawyer" said nothing about it...

I totally agree. You get so much information through reading threads. Much more accurate. I find our lawyer to be very approximative. We got a RFE (for a document I know he has well sent) and instead of telling the truth like "yes guys your file is going to be a bit delayed" he said to us that it is not going to delay anything at all. As if we could not cope with reality (or as if he was taking us for idiots). And same than you, our lawyer never mentionned the I-129F form... honestly with visajourney.com you pretty much get all the infos you need + support 😉

USCIS - FILING FOR I-751 (CR1)

May 21st 2022 : package sent (with Fedex / Delivered on May 23rd) 

May 27th 2022: case received with Receipt # (NATIONAL BENEFITS CENTER)

May 31st 2022: NOA received. I-797 (24months extension)

June 11th 2022: NOA for a Biometrics appointment (set for June 30th - need to reschedule it - not in the US on that day! 😱)

June 14th 2022: walk in at the Center - all went well. Biometrics done!

December 8th 2022: Received a Notice of Action. I-751 APPROVED! 🎉

December 10th 2022: New GreenCard received in the mail 🥳

@MrsVybez From what I recall I129 is only for fiancée, right ? So I realise the reason why our lawyer has not mentioned it is because we were already married...

Yes, so its says the form is for spouses and fiance... I had to check myself. Nevertheless I am thankful for every piece of info I do get. Good luck to you. I know we aren't too far behind from the rest of the approvals..! 😉

Apr 13, 2019:    I-130 Sent (Chicago Lockbox)

Apr 15, 2019:    USCIS received package

Apr 22, 2019:    Received NOA1 (Texas Service Center)

Nov 6, 2019:      NOA2 

Jan 7, 2020:      NVC Case # Received (notification via email)

Sep 30, 2020:   Documentarily Qualified

So at least your attorney didn’t say anything.  When I was filing for I129F K3, there were multiple attorneys and individuals on VJ that were stating that it was an obsolete process and how wrong me and a few others were for even considering filing the I129F.  I’m the one laughing now.  Our I130 was approved in 5 months a far cry from the 12-16 months that the USCIS states that Nebraska takes to approve.

 

So here’s the deal, the I129F K3 seems to mostly work on LIN numbers (Nebraska SC). There are 100’s of individuals that have now been approved, not just a few.  And it is not too late to apply.  There are people that have applied at the 12 month mark.  The cost is nothing if you have applied for your I130 and received your NOA1 notification.  There has been no down side to this.  It is legal and absolutely nothing wrong with filing it.  Because of the increase in filing, they are taking longer, some 60-90 days but it’s still better than waiting 16 months. 

 

I realize you are through the process now, but honestly you were in the Texas SC so it would not have most likely helped to file the I129F.

Just waiting for the i864 fee to go through and then uploading that as well.

10/01/20 Card in production

02/15/20 Move to the US

06/2021 Finally received Greencard

I got approved, finally! Took 16 days from delivering the RFE. Thanks for the good counsel!

Hello Miriamc, my husband and I got a RFE exactly for the same reason than you 🤔... divorce decree in English (which we -like you- definitely had mailed with our petition)... We are sending it back tomorrow (express way). Which me luck 😉 - I wish you good luck for the rest of your process 🤩
