Do I need my 2nd tetnus booster before AOS interview?

Hi I would appreciate all your help with this, I’ve read so many articles but none that are quite the same as my issue! 

 

I sent off all my AOS paperwork with my completed DS-3025. At the bottom ‘K Visa applicant voluntarily completed vaccination requirements’ was ticked. 

 

However, at my medical I had a Tetnus (Td) booster and it was marked with a B (insufficient time wavier).

I was also given a slip to say I needed a 2nd tetanus booster in 6 - 12 months. 

 

My question - Will I need to have this 2nd ternus booster before my AOS interview and get a civil surgeon to fill out a new I-693?  

 

Or will my current DS-3025 be sufficient? Is this 2nd booster voluntary?

You should be allowed a waiver for "insufficient time interval" (for your AOS) because you were as complete as medically possible on the day you were signed off. At your interview, we can't predict if your adjudicator will have studied his handbook or how he will view it. So wait to see if you are asked to go get any further shots.

 

What you explained does not actually make sense to me. You said you got a Tetanus shot at your medical exam. Tetanus would not be due again another for 10 years.

Because you were given a waiver at the overseas medical exam, you did fulfill all that was required which is why the DS3025 was ticked complete. You will never have to get any other vaccines to satisfy anything as long as you file AOS within one year of your overseas medical date and regardless of when you will be interviewed.

From the I693 instructions:

 

"3. What if I am a K nonimmigrant visa holder and already had a medical examination overseas?

If you were admitted as a: A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e); or B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen; and C. You received a medical examination prior to admission, then: (1) You are not required to have another medical examination as long as you file your Form I-485 within one year of an overseas medical examination; and (a) The panel physician did not find a class A medical condition during your overseas examination; or (b) The panel physician did find a class A medical condition, you received a waiver of inadmissibility, and you have complied with the terms and conditions of the waiver. (2) Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. (NOTE: That says "complied" (past tense, meaning you complied with what was required AT your overseas medical and received a waiver (ie an exception) for everything you could not comply with for one reason or another). If the vaccination record (DS 3025) was not properly completed and included as part of the original overseas medical examination report, you will have to have the Part 9. Vaccination Record completed by a designated civil surgeon. In this case, you must submit Parts 1., 2., 3., 4., 6., and 9. of Form I-693."

 

You dont need to do anything but submit a photocopy of your DS3025 with the I485, bring your copy to the interview whenever that happens and remind the IO that you were a K1 Visa holder who completed your medical requirements overseas. They will retrieve your overseas medical exam from your A-file at or after to the interview.

 

**you can also bring a copy of the above I693 instructions and print out the section in the USCIS policy manual that explains K1s medical requirements as an exception to the I693 requirements to your interview to act as evidence for an uninformed IO.
