Yes It was delivered to Uscis on 04/05 but no NOA yet

Hi everyone! We're planning to file this month, but I have one question: when we received our hard copy of NOA2 back when we did the K1 visa, my husband was moving and apparently he lost that paper.. 😑 is that a problem, something I should be worried about?

If one of you scanned it at some point and so can print out a copy, it's not a problem; they don't need the original.

 

Otherwise... reading the I-485 instructions again it's not 100% clear that a copy of the NOA2 from your K-1 is strictly required for AOS from a K-1; you do need to show your immigration status and eligibility to adjust but a copy of your visa and marriage certificate seems like it might be sufficient for that. You do need your A# (I think you can also get this from your I-94) and your petition # to fill out the form. I believe there's a thread from not too long ago here about what to do if you don't have a copy of NOA2 available; I think it was suggested there that there are things you can do to not have to pay the fee for a new copy of NOA2 (which is over $400, IIRC).

Ok so... as I mentioned before I sent my package already but before I witgdrew my previous application with uscis based on my first marriage, However no NTA was sent out to me and also I valled the number 800-898-7180 to make sure I was gpod sending my new application, they received it las friday but today I received the NTA and the reason was my visa overstay, so now I’m confused as to USCIS will still adjudicate my case as I sent in my package before this NTA was issued or will they still adjudicate it to immigration court. 

 

Any thoughts?

I had to resubmit our application because we somehow didn't sign it (even though we signed the other copy that we kept at home!). So, I was a March filer, now I'm an April filer, and just like last time, my package has been "In transit, Arriving Late" for days now!

Last night I received text messages about my case being received lets hope and pray this NTA stiff is nnothing to worry about.

Hello all,

I am trying to file all my forms this month before the K1 (90 visa) expires on April 25th of 2019.  I am seeking some guidance in regards to some of the issues I am encountering and I hope those of you whom have already filed can provide that.  I do believe I have about a 70% solution…

 

  1. My wife and I married on March 30th of this year.  Since the date of marriage she has opted to take on my family name.  I took a copy of this marriage certificate to the Social Security office and applied for a SSN in her family name.  She is currently pending issuing of her SSN card after immigration information is verified (she is still within the 90 day visa).  She was awarded a letter from the SSA with the married family name.  Previous to this action, she has not been issued a SSN.  This was her first and initial visit.

  2. My wife has been issued a defense eligibility card (ID card) from the military with her new married last name.  I am including this as a copy in the packet.

  3. When filling out the forms (Form I-485, I-1765, I-131) can I start using her new married name where it asks for family name?  Obviously most forms asks what other names she has used since birth…which I put her birth name.

  4. Form I 485 (Application to Register Perm. Res. Or Adj. Stat.)

    1. Is there a need to write a letter “detailing why I am sending a payment of $1225.00 versus a payment of $1640.00” to file for (Form I-485, I-1765, I-131)?

    2. I am being told that as long as I file all the forms (Form I-485, I-1765, I-131 together with Form I-485, there is only one fee that I need to pay?  $1225?

    3. Medical Examination:  i did not receive a copy of her medical record, but I did receive a copy of the vaccines she received.  Also, I took her to get additional vaccines she was needing, to ensure she is up to date.  Are there any specific vaccines needed for her AOS prior to interview?

  5. Form I-131 (Application for Travel Doc.)

    1. Page 4 of 5, Part 7. Complete only if applying for Advanced Parole

    2. “On a separate sheet or paper, explain how you qualify for an advance parole document, and what circumstance warrant issuance of advance parole”  Does anyone have any guidance on this question and what they have put into this section?
