1225 for 485 and 535 for 130/130a. Adjusting from non-immigrant TN to spousal based green card. They took both forms with the CC payment. Did we overpay? Maybe they'll process it quicker with the extra cash! ;)

Hi everyone!, hope someone can help me out.

The AOS Form I-485> page 3> Part 2> 2. Says:

"Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)?" Is it yes or no?. I selected yes, because under the cuestion says: "you must have selected a family-based (k1 is considered a family based visa), employment-based,etc as the basis for your application for adjustment of status. Fill out the rest of this application and the Supplement A to Form I485 Adjustment of Status Under Section 245(i) (Supplement A).

K1 holders also must fill out this supplement? I read the I485 instructions but got even more confused. hope someone can help me out ❤

Hi everyone, my wife and I got married on the 30th of March and filed off all of the appropriate AOS documents to the Chicago PO box on April 15th. USPS says it was delivered on Wednesday the 17th of April, but we still have no sign of an NOA1, text, email or anything! Starting to worry, especially as my visa ends May 10th! Don’t know what to do!

Sometimes it takes a long time to get the NOA1, after 30 days you can call and open a service request. They are so swamped right now though it is likely just in a pile waiting to be filed. You definitely aren't getting a green card before May 10, but you will be in "AOS pending" status in the mean time which does give you the privilege of staying in the USA legally while it is in processing. This is the same status you would have if you left the country and re-entered on AP.

I wouldn't sweat it.

Thanks very much. My main silly worry is like what if it got lost, I call up to open a service request after 30 days (after my 90 days expired) and they say “we have no record of you sending it, also you’re now out of the 90 days and didn’t file get ready to be sent back home”

A very over dramatic thought but you know how this visa stuff makes the mind jump through some pretty terrible hoops!

Yeah I get it! I had my biometrics on 4/19 and haven't had any update since so I'm impatiently waiting and wondering myself. The bottom line in your situation is that there is no time limit on when you can file, and unless USCIS files a removal order, which I'm sure they won't any time soon, you will be fine. I would certainly avoid CBP in the meantime if you have them in your area. I live a couple miles from the Canadian border and see CBP every single day, it's a little nerve wracking when you are out of status. But they certainly aren't going to hunt you down. Remember, this is the feds we are talking about, it takes them 2 years to process a single application. They have much better things to do then kicking in doors of people with immigrant visas that are a few days expired.
