I wanna go to my counrty with AOS still pending in CSC,what will happen if i travel w/o AP,and return with GC?

How will return with your GC if your AOS is still pending when you leave?

apparently GC comes to mailbox one day "hopefully'.

I mean, how will you get the GC in your hand if you are not in the country? You will need it to re-enter.

What if a request for you to come to the local USCIS comes in the mail first instead? If you leave the USA without AP or your Green Card in hand, then how would you get back if there are any problems which require you to visit a USCIS service center?

If you think you want to travel, why not apply for AP now, get it, and then go. If your Green Card comes before your AP is approved, then so much the better.

Why take any chances at this stage?

  • MARCH 14, 2007 WE ARE MARRIED!!!
  • May 5, 2007 Sent AOS/EAD packet
  • May 11, 2007 NOA1 AOS/EAD
  • June 7, 2007 Biometrics appointment
  • June 8, 2007 first post biometrics touch, June 11, next touch...
  • August 1, 2007 AOS Interview! APPROVED!! EAD APPROVED TOO...
  • August 6, 2007 EAD card and Welcome Letter received!
  • August 13, 2007 GREEN CARD received!!! 375 days since mailing the I-129F!

    Remove Conditions:

  • May 1, 2009 first day to file
  • May 9, 2009 mailed I-751 to USCIS CS

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

If you leave without AP or your Green Card, you are abandoning your AOS application. You could go and maybe the green card will be approved with no interview and with no problems, but that's a pretty big risk to take. If things don't work out, you'll have to start the immigration process over from scratch.

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Are you saying your GC is already approved and it's in the mail?? That your husband will mail it to you, when he receives it?

You'd really have to trust the postal service or courier not to lose it.

seems like a really, really bad idea with lots of potential for problems and errors and huge difficulties down the road if the tiniest thing goes wrong.

If you leave the USA with your adjustment application still pending, and without advance parole, you abandon the application.
