Haven't filed 2018 taxes yet - will this be an issue when filling out form I-864EZ?

Question 5.a. on form I-864EZ asks if income taxes have been filed for the most recent tax year. I will have to enter "no" since I have not filed them yet. Will this cause an issue? I can and will show taxes for 2017, 2016, and 2015.

Before april 15th ,you are not obliged to list 2018 tax but need to present at later date .

I am filing for an extension so will not have them complete by April 15th. When will I have to present 2018 taxes?

September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Can anyone advise if not providing 2018 tax returns will be an issue? My I-864 is available to fill out so I do not want hold up that process while I still work on my 2018 taxes. I made slightly more in 2018 compared to 2017, 2016, 2015.

No issue.  Beneficiary should carry 2018 return to the interview.  Before April 15, the most recent previous year return refers to 2017.

That is interesting. So when answering the question "Have you filed a Federal income tax return for each of the three most recent tax years?" I can put yes since it is still referring to 2017, 2016, and 2015?

The I-864EZ form states that you MUST provide photocopies of most recent taxes OR transcript. On the I-864EZ instructions however, it states that you must submit copies of your W2s and latest tax returns. Will the transcript not suffice?

Interpret the word OR literally, but take the 2018 transcript to the interview.

Ok, thanks. Is the I-864EZ Instruction Form incorrect/outdated since they do not mention the option of submitting your tax transcripts?

In a way, yes.  In the past either/or was correct and it still is for NVC.  However most Consular IV units have recently started requiring the latest transcript at interview.  When are you planning to file the 2018 return.  It's due next week anyway.

I was going to submit my I-864EZ before the 15th, that way the most recent tax year would be 2017. 

 

Would you suggest waiting until I have my 2018 taxes complete? They are being worked on right now, I am anticipating that they will be done in a few weeks. Since my spouse is in India, I am filing MFS with N/A as spouse SSN and snail mailing to the IRS. I have read on this forum that this is the best option. I will later amend the taxes since I am due a bigger refund if I file MFJ (which I cannot right now without a SSN or ITIN for my spouse).

 

I fully anticipate having my 2018 taxes completed before the interview. Do you think it is risky submitting the I-864EZ before April 15th to try and "sneak" in my 2017 taxes since 2018 is not complete? Will I get an RFE? Since I am paper filing 2018, I don't want my I-864EZ submission to be delayed.

Since I advise just that, no, I don't think it's risky. What would be risky is for your wife to show up at the interview without the 2018 transcript.
