By the way this is also written in the visa.

"IV docs are in CCD"

"UPON ENDORSEMENT SERVES AS TEMPORARY I-551 EVIDENCING PERMANENT RESIDENCE FOR 1 YEAR"

Based on your post above, once you enter the US and the CBP stamps your visa, you are a legal resident... You can work. You do not need to adjust your status ... nor apply for  EAD

I will be immigrating with my wife. She is the main applicant. She is not a US citizen or have a green card yet.

Yes we already attended the interview at MTL and received the visa.

This is written on the visa

Wait? You both applied for a Visa or your wife applied for a Visa and was approved?

Did you apply for a Visa at well for yourself and were approved or just her?

All 5 family members got the immigration from MTL. My wife, myself and 3 kids. We applied as a family under my wife.

My wife is the main beneficiary.

Okay well I think I understand but not too sure.

If you have an approved F2A visa (which is what it sounds like) then you will be admitted to the US as an LPR and receive your GC shortly after arrival. That could take up to 120 days to receive but it sounds like you already have an I551 stamp in your passport making you eligible to work right away. In that case your TN visa would be null and void upon arrival but you could use your I551 stamp to work while waiting for your GC to arrive.

All of this talk of EAD has me confused though as I'm not sure if you were told you needed that in error or if you actually do need an Employment Authorization Document and you are just not explaining your Visa situation accurately.

Just one more thing to ask. After giving the landing, can we travel back to Canada and back to US or we have to wait till we receive the GC.

Thanks,

The visa in your passport serves as a green card for one year so you can travel

Thanks,

After landing, the visa in your passport acts as a temporary green card. With that, you can travel and work and live in the US. When the GC arrives, which should be automatically in about 3-6 weeks after you arrive, the visa is no longer needed.

If you intend to continue to work for the employer you’re working on TN right now, all you need is to inform them your change of status: you’re now a Permanent Resident, and fill out another I-9.

Note, as LPR, you are free to travel outside the US but need avoid long absences from the US and you have to demonstrate your intention of living permanent in the US.

*~*~*moved to “bringing family members of USCs” as OP is an F-3 (married son/daughter of USC)*~*~*

OP, it appears you are confused. You won’t be going through adjustment of status and won’t be applying for or needing an EAD. You will be an LPR the minute you pass the CBP and have your passport stamped when you enter with the immigrant visa.

Timeline in brief:

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Now a US citizen!

OP is a derivative beneficiary of his wife's petition.

OP - once you get the stamp in the passport while crossing the border first time after receiving immigrant visa, you will be legal permanent resident. Plastic green card that you will receive later will only be a proof of that, but you will obtain the status while crossing the border / getting your passport stamped and you will be eligible to work in US.

This is awesome guys. Thank for all the information. Yes we were confused as this information that you shared is not available on internet. Maybe I was unable to get it out myself but the available information only tells you that you need EAD and or GC to work if you are immigrating. The information shared with us above is very very informative and important. Yes I am aware of $1,100 that I have to pay for the GC :)

The I-9 form says I-551, EAD, etc.

I-551 = Green Card Document. Your CBP endosered immigrant visa is an I-551 document; https://www.uscis.gov/i-9-central/temporary-i-551-stamps-and-mrivs:

You can work, travel, etc. right after US entry.

Yes, that is true. You will need EAD or GC to work. You will have the GC, so no need for EAD. Again, as mentioned, as long as you pay the fee, the GCs should come automatically to whatever address you provided in about 3-6 weeks after you enter via your immigrant visa.

Thanks

Ian
