That's good news. I have to say he's a lucky man to have an understanding fiancee who is willing to wait through this process and then marry him, which will result in his overstay being forgiven once AOS is filed. He should have to wash the dishes every night for a full year for penance on this one. ;)

I'd say we're equally as lucky but I wouldn't object to a dish-free year! But thank you! I can't say I know the ins and outs of the process like others here but from what I've read I know it definitely requires patience. I know it'll be worth the wait! :)

Update and a question!

 

We received his new passport, woo hoo!! Still slowly working on getting everything together as we await our wedding day (8/15!! :)) but will his new passport be an issue? Copies of the beneficiary's passport are required multiple times with copies of entry stamps also - his new passport does not have this and it does not have the same numbers as his previous  one. He had his old passport number saved so we were able to pull up his I-94  but the numbers do not match.

 

Any ideas on how to address this or if it will be a problem?

Congrats! I don't see any serious issues for you going forward. You'll have to explain in a separate letter, submitted with applications, that he lost his previous passport so no longer has access to physical evidence of previous entries/departures. People lose passports full of such stamps, every day. As for the electronic i-94 dates, you'll have to explain any discrepancies also by letter, preferably with proof such as airline/hotel receipts, etc. The key thing is, he has a passport which is a basic requirement for submitting the AOS documents. Thank you!  I didn't think it'd be that simple!

 

For the I-94, the dates are correct. It's just the passport number on it is his old one. Do you think one letter explaining the lost passport situation will suffice? Or just to be safe we'd be better off with another letter, re-explaining why the I-94 passport number doesn't match the current passport numbers? I'm not sure if I'm over explaining, ha. But thank you again!

Did you guys get married on the 15th?

Thank you for replying, that gives me some relief! We do have his most recent I-94. Did you add a letter or anything explaining the passport he entered with had expired?
