APRIL 2019 K-1 NOA2 ----> NVC

Hi guys, I’ve asked this in my sub-forum but would also like additional advice here.

About a month ago, we received P3. One of the documents requested is the most recent tax transcript. Since my most recent tax transcript is 2016, we waited until end of June for 2018 to be processed as stated on the IRS website... well, nothing showed up on my IRS account and when I called, they never received it. 😭Since I have to send in another copy, it will take at least 3 weeks to process. We didn’t want to wait any longer so we sent in my 2016 tax transcript, mine and his bank statements, statement from my employer, etc. Everything points to having well above the income threshold. I’m concerned they will still request the 2018 tax transcript. I wrote a statement to the consulate saying that 2018 is still processing. Did anyone else have this issue? Are consulates understanding of tax returns still being processed? Thank you in advance!

8 million visas are approved each year do you think there is a possibility that someone else has your same situation. YES.

 

You will have problems at the interview if you do not have current taxes completed. Since you have a paper form of the 1040 you could email it to the beneficiary and then print it off there for the interview. Explain your situation and they may except it.

Complete instructions and forms may be downloaded from http://www.uscis.gov.

Proof of U.S. federal income tax returns: The most recent IRS-generated transcript of the most recent U.S. Federal Income Tax Return (1040) and W2s are required from all U.S. citizen sponsors/ joint sponsors. A person may obtain a free IRS-generated transcript by filing 1RS Form 4506-T (Form IRS-4506-T) with 1RS, Request for Transcript of Tax Return. K-visa applicants may present their petitioner's Transcript of Tax Return, or their own assets as proof.

Do i need to contact NVC to know if they receive my case as my wife receive  a mail from USCIS shown that they send my case on 11,Jun 2019  now pass 24 days with out any mail or feedback about my case status

Good day guys, I would like to ask something about my k1 visa. A friend of mine chatted me and told me about her experience at the immigration of her POE. They filed last August 2018, got approved by January, got approved on her interview by March and VOH by April. Her flight was June. She said that the immigration officer checked her I129f packet inside the yellow packet and saw that her packet will be expiring in 1 month and 1 week, and why she only decided to fly in US by that time. So she is very concern about my situation, I am a January 2019 filer and plans to fly to US by January of 2020, the reason is, my fiance is a navy and currently on his deployment and coming back in US on October. And he's planning to celebrate new year here with my family. I'm planning to have my medical by July and interview on August. I'm so confused, why does the immigration asked her about the i129f packet, I thought what matters is our visa that we need to fly to the US before it will expire. (Within 6 months) Please enlighten me. Thanks!

Some immigration agents concern themselves with those date to insure that you are compliant. Most don't make a comment but this particular agent did. As long as your feet are on US soil before the expiration date within your passport expires you are good to go. With a fiancé in the military, your situation is easy to explain away and I am pretty sure you won't have any problems. BTW, don't fly the day before you visa expires as delays do happen along the way and you don't want to be outside the country when your date expires.

 

Keep in mind that the expiry date for the visa is based on the medical exam date. So schedule the exam date as close to your interview, within reason, to maximize your time from visa issue to when you need to step on USA soil.

Call NVC to inquiry about your case. Phone numbers and instructions are on the first page, first post of this thread. Since this is a K-1 thread I recommend that you search out the CR-1 threads so that you don't receive the wrong information. I recommend that you complete your profile so others know you are a CR-1 and what country you are applying in. Here are the instructions.

Thank you so much! My plan is to have my medical on July 31st so it will expire on January 31st 2020. And I plan to fly on first week of January.

Nothing to be nervous about. The beneficiary should know about the petitioner including his/her background. Sometimes the petitioner will send the a copy of the I-129f application for the beneficiary to review as it contains a lot of information they maybe asked. During the interview, look the CO in the eye when answering questions as it shows you are paying attention and that you are confident in your answers. When asked a question, keep it short and to the point. Don't tell a story as what you say can be "held" against you for further questioning. Be honest with your answers, and if you don't know the answer to a question, say you don't know. DON'T make something up. Here is a list of questions they may ask.

Dress business casual to not bring attention to yourself. Don't forget to ask at the end of the interview  "Am I approved?" and "what is the process to receive my visa".

 

Your visa is pretty much approved before the interview. The CO at the interview needs to do the last step and that is determine if you have a genuine relationship. That's basically it.

@Greenbaum thank you so much. I was at the embassy last year when applying for my B-2 visa and it was pretty smooth  ( I remember being sooo nervous). We even made jokes and laugh. I know what to expect now but still being anxious if all papers are prepared correctly.

Having paperwork issues is not a denial. Probably you'll get a 221g to supply them. Don't assume you know everything.  Just be prepared. Good luck.
