Signing an affidavit of support (I-864) for a fraudulent marriage. Consequences?

Not sure what you mean. She could be making the fraud marriage--I'm just speaking for the scenario where it is investigated and is determined to be fraud. And she does say she knew it was fraud from the get go, but just wanted to help. 

 

I believe her, that she didn't understand what the affidavit of support meant. She still signed it, despite finding it "confusing". 

 

So she willingly helped support a fraudulent marriage, and hopes to absolve responsibility on her end by just making it all go away, literally. 

 

Of course, if the marriage is not a sham, nothing will happen whatsoever, besides her still being on the hook.

I actually came across that post on reddit too. I'm beyond baffled by that post. She actually states that the verbiage of the document is confusing (it is not) and proceed to sign the document under the perjury of law that she reviewed and understand everything in the documents. How can she sign anything testifying that she understood the document when she didn't, and she intends for reddit to help her instead of going to an actual lawyer that probably know how to best remedy her mess and hopefully for a hefty fee.

My timeline

Naturalization pending (5 years rule)

Local USCIS office: Chicago, IL

 

07/24/2024 Case submitted online

07/24/2024 Biometrics waived

09/12/2024 Interview scheduled

10/31/2024 Interview

10/31/2024 Oath Ceremony will be scheduled

For some reason reminds me of Jussie, and he got off.

 

I find the whole situation vaguely amusing, I know it is common but wonder what the numbers involved are, not that we will ever know.

 

How come a friend can collect proper evidence that this was a fraudulent arrangement? Seems unbelievably unlikely.

And this is why the rest of us are in limbo waiting for long periods of time because people like that doing stupid stuff and taking up time that WE the LEGALLY married people are longing for.  There is no excuse as to why she signed the paper.  I re-read my AOS multiple time so that I was clear as to what I was signing and he is my husband.  She might as well go ahead and wait it out until 2028.  He has what WE all in here waiting for.  And she mad and in her feelings now and could end up in jail and they could still be out here living their best life.  I can't say what to do but this was just me venting about how stupid and irresponsible she was in even participating in this process without knowledge of what she was getting into.

It's 2028 if he earns 40 quarters of work credit.  It could be pass 2028 if he doesn't get 40 quarter.

As soon as she knew it was a lie, WHY IN THE HELL DID SHE THINK IT WAS OK??? I'm assuming she thought it was a good idea to go to jail for someone else's happiness????? I swear you can't make some of this ####### up!! Please come back and let us know the outcome.

I tend to agree with you, if she knew it was fraud beforehand then she should also face consequences as an accomplice to someone that obtained fraudulent immigration benefits.

What happened with Jussie? 

 

She was saying that she knows where the immigrant in question lives (not with the "wife") and knows that the lease agreement was faked. He also provided a copy of his green card to her, for some reason, so who knows what else she has access to.

Hi everyone,

 

I am a 23 year old female, I became best friends with another female we will call her Nikki. She is an illegal immigrant, overstayed her J1 visa for about 4 years. Her boyfriend, we will call him Will, is also an illegal immigrant and married some random woman for his green card. Nikki and Will live together with Nikki's sister Jill who is also illegal. They created a fake lease to make it seem like Will lives with his wife. They did not come here for a better life, they were actually pretty comfortable from their country Serbia. They basically stayed because it is more fun here and they can make their own business easier.

 

She asked me to Sponsor her boyfriend Will because he was trying to get his green card. They told me it is only a formality, and that I would be responsible for him if he didn't have enough money for food but only until he got his green card. I said okay sure I will do this. Now Will has his green card, but I found out I am still his sponsor until he gets citizenship.

 

I was unaware of this and to be honest I am kinda pissed. I feel blind sighted. I do not want to have this responsibility for that long. I know I am stupid and should have further researched this but now I don't know what to do. I do not want him to get any government benefits because then I would have to pay the government back.

 

Nikki also asked me to marry her and I said no. She found someone willing to marry her but now I am scared she will ask me to sponsor her too.

 

I told Nikki today I found out I am still his sponsor until he gets citizenship and she said that is so weird and to not worry.

 

what should I do in this case? Should I report them? What is my best case and worst case scenarios? how should I handle the situation?

 

tl;dr My best friend asked me to sponsor her boyfriend, and I realize they gave me false pretenses

There is no requirement to live with his wife, some days I think half the posts on VJ relate to people who immigrated and then broke up. How many marriages survive? I think most people divorce before they die.

 

Copy of GC? Why and I have no idea what that would prove.

 

I read the thread, saw no evidence mentioned.

She was saying that the lease agreement was faked, not that they don't live together and that's her spiel in and of itself.

I have no idea what evidence, if any, OP has. Based on the replies here, submitting any such tip won't go anywhere anyway. 

 

My original question was targeting the assumption that the marriage will be investigated (no matter how improbable) and will be found fraudulent. Is the sponsor good to go? No issues with signing an affidavit for a fraudulent marriage? That's the only thing I'm curious about. I'm sure this scenario happens more often than is ideal.
