Change of Employer while H1B being filed

If they are committed to paying it, why are you waiting before resigning as per your earlier post? Then you should do the right thing and resign now.

i asked HR and they said even though bonus is committed as annual pay, its procedure will be followed as other bonus payouts. 

I am giving them 2 weeks notice after resignation so no issues there.

I did, i saw someone mentioned you cannot transfer H1b to different employer if you change jobs, but I have seen that at my work as well.

 

also just shared fee as there structure as things may have changed from before. it may be incorrect.

...other than the money they're wasting on your H1B application, you mean? Well, if you are comfortable that they will also think that is "no issue" then I guess you'll be fine.  No plans to get a reference from the company in the future?

I feel bad for the next guy they hire.

Somebody did something like this with our business once. Let's just say there's no opportunity for it to happen again now. 🤷‍♂️

 

Edit: Heck, after somebody took 2 paid weeks of training (plus expensive training costs) then left right afterwards, they severely cut back any form of non-required training for everybody.

unless it's a really big amount it's very short term thinking

like i say, i have seen this in the IB/HF industry where we are talking serious money, and it's kind of expected (and the quid pro quo is usually gardening leave/restraint of trade for a few months), this sounds a bit short sighted but anyway OP knows that by the way he is running around with the story rationalizing it.

Hurts more if you are a small business and let's face it there are so many other areas you are at risk.

I don't actually understand why companies file H1s and file green cards for H1 employees when so many of them just jump ship afterwards. Seems stupid, unless the guys are being underpaid to begin with which might make it make sense

i was able to request H1b application withdrawal. 

 

I guess people are too judgmental without knowing exact situation. the forum should help with technical issues not pass judgement. 

I told you that they want me to relocate and I excused, they still want me to give options and keep me due to my services to them which have helped them keep a important client.

I assume a numbers game, the balance between what you can save on wages versus the number that jump ship. Offshoring would seem simpler.

A nonimmigrant employee can change employers. However, the new employer first must file a labor condition application (e.g., H-1B petitions) or temporary labor certification (e.g., H-2 petitions) and then file a new Form I-129 petition with the approved labor certification.
