we filed the i751 removal of conditions as her 2 year green card was about to expire. we filed in jan 2018, along the way after several months we got a notice saying a biometrics appt. was not necessary, but of course they keep the money. we live in oregon and then in february we get a notice saying it has been transfered to another office back east. why would they do that? we have now been waiting almost 15 months for her 10 year green card.

cant we technically apply for citizenship now even without the removal of cond.

its been over 3 years since she had her first green card.

thanks....

Well hello from a Gresham'er here.

ROC can take a long long time for some people, relax.

And yes, if she qualifies under the 3 year marriage rule she can file N-400 even with ROC pending. They usually approve both at same time but you can do it if she is within the proper time frame.

15 months is the current minimum processing time for ROC (across all offices) so you’re certainly within the “normal” processing time.  They sometimes move files to even out the workload, so that’s also normal and not a cause for concern.

And yes, you can file for naturalization with the 751 pending.  It’s common for people to have a combination interview for both.

Since you've been married to USC for 3+ years after your initial GC, you can absolutely apply for citizenship under the 3 year rule, even with ROC pending.
