ANNULMENT IN THE PHILIPPINES

Hi all,

Relyn and I have what could be our last hearing on june 18, 2007. we do believe this is actually the last one. Me the optimist thought we would be done in december with the annulment..........lol.

my question is how long is it in all of your experience after the last hearing to wait for the judges decision. our attorney thinks it could be as much as three months.

4 september 2005.....relyn and patrick chat on filipina heart for first time

19 december 2005....patrick flies to meet relyn and m'r (son) for first time

24 decemeber 2005.....we are ENGAGED!

25 december 2005....we fly to boracay. patrick and relyn exchange wedding rings on plane....lol but true

3 january 2006....we meet with attorney to discuss annulment of relyn marriage.

(husband absent for 6 years)

20 august 2006.......patrick returns to philippines

21 august 2006......patrick birthday

28 august 2006......we travel to baguio city till september 5

4 september2006....we celebrate in bagiou our 1st year anniversary of knowing each other.

10 september2006.....patrick back in u.s

19 april 2007....back together for another trip

21 april 2007....we travel to province relyn and family are from for a chance for me to meet extended

family. we are there for more than a week.

7 may 2007....return to the u.s.a.

JULY 2007.....annulment sent to judge desk awaiting decision

OCTOBER 2007.........JUDGE GRANTS ANNULMENT......YIPPEE GETTING CLOSE TO FILING I129F

31 december 2007 I29f sent via US postal priority mail

4 January 2008 NOA1

6 MAY 2008 NOA2 (GUESS THE TOUCH WAS A REALLY GOOD TOUCH)

10 MAY 2008 RECEIVE HARD COPY I-797 NOA2 IN SNAIL MAIL

22-23 may 2008-early medical(passed)

22-27 may 2008-son's medical....very long bcoz of tuberculin test

20 june 2008-my patrick visit me again for 4time

23 june 2008-interview u.s.embassy

27 june 2008-got my visa yipeee so quick!

2 july 2008- fly in tacoma wa, with my patrick and son

Hi. I was into the same process too. Mine was submitted for decision Aug 2006, it wasnt made final until November that year. I am not sure as to Relyn's case, but if the lawyer says so, then maybe you can count on that. Actually, the decision will still be submitted to the solicitor general in manila and will wait until 15 days or more then it goes back again to the court for finality, for another 15 days posting. So give it another month from the time decision is made then she is done.

I filed mine last March 2005, had the last hearing on November 2006. The court staff told me that the judge has 90 days to make the decision after the last hearing but I got the decision last week of March 2007. And then i have to wait for another 15-30 days for the Certificate of Finality & the Decree(by the way the Decree is the most important document that the US embassy would look for during the interview). They told me that my ex has a chance to contest the decision within 15-30 days but if he didnt make any move then I can become single again. I got mine officially a month after the decision.

05/18/07 married

05/29/07 sent I-130s for me & my daughter at CSC

06/16/07 checks for I-130 cashed

06/19/07 sent I-129F not waiting for noa1 but with printed online copies of checks cashed

06/25/07 check for I-129f cashed

06/29/07 transferred I-129f to CSC

07/03/07 received noa1 in the mail for I-129f

10/31/07 approved K3 and my I-130 except for my daughter

11/05/07 received NOA2 in the mail

12/01/07 received mail from NVC/yey we got our case number

12/20/07 went to St. Lukes and had my early medical exam

01/30/08 schedule for medical

02/07/08 interview, approved!

02/12/08 visa pick-up/cfo

02/14/08 POE-LAX

06/19/08 AOS mailed thru USPS

06/22/08 AOS delivered to Chicago IL

06/28/08 check cashed

06/30/08 received NOA1 dated 06/25/08

07/26/08 biometrics appointment

09/09/08 received EAD card in the mail

12/03/08 received interview letter for Jan 21 2009

01/21/09 approved for conditional permanent residence

02/02/09 permanent residence card arrived in the mail

10/21/10 submit form to remove conditions

01/21/11 10 year gc received

03/05/12 mailed my N-400

03/06/12 received email that they have my N-400

We started our annulment process in August 2005. We had the final hearing in July 2006. We finally got the copy at the end of Jan. 2007. But misspelled name had to be corrected. Hence we could not file till March of 2007 for the K1. I did not want to believe the lawyer, that it would take that long, but it did, and then some.

OUR TIMELINE

MARCH 7, 2007 - SENT I-129F TO CSC

MARCH 13, 2007- NOA1

MARCH 19, 2007- REC'D BY SNAIL MAIL

May 23, 2007- APPROVED!

May 24, 2007- Rec'd e mail stating I was approved on the 23rd!!!!

May 29, 2007- Arrives at NVC

May 30, 2007- Called NVC and received MNL#

May 31, 2007- Left NVC headed to MANILA

June 4, 2007- Petition Arrives at USE Manila

June 12, 2007- Packet Mailed from Manila

June 25, 2007- Rec'd Packet

July 27, 2007- Medical appointment Aug. 3, 2007- August 3rd Interview, APPROVED!!! 149 days from filing!!!

Sept. 7,2007- Mary will be landing in LAX

Hey Patrick and Relyn,

Unfortunately, I think your attorney is being fair and it will take at least 3-6 months after the final hearing to get your Certificate of Finality. Believe me....I know exactly how you are feeling. You want it to be over so badly and it just keeps dragging on and on. Well I can't tell you when, but it does come to an end and you will get what you are looking for in time. Sometimes I think waiting the 18 months for the annulment strangely enough made my relationship with Mirasol even stronger. Not sure if others will agree. Something about that saying, "Absence makes the heart grow fonder." My sweetheart is here with me now and yours will be too in time. How sweet that day will be! Hang in there my brother!

hi eddie&mary im just wondering what documents did your fiancee showed them on her interview? is the CERTIFICATE OF FINALITY different from the DECREE OF DECLARATION OF NULITY OF MARRIAGE? coz i think their both the same

This is what my fiancee told me, since she is a lawyer there in the Philippines.

Yes, the judge has 90 days to make the decision but he can also issue it earlier. If your fiancee has a friend working in the court maybe he or she can help her so the decision will be issued earlier. After you and your ex husband has received the decision, you will start counting 30 days but sometimes it takes 45 days because the Solicitor General will be given the time to make an opposition , if any, or the ex husband to make an appeal. Once there is no opposition or appeal , you can already get your Certificate of Finality stating that the Decision has become final and executory AND a Decree of Nullity. The Decree of Nullity is issued by the court ordering the Civil Registrar to erase or cancel the marriage from their record and also ordering the NSO to annotate the same on the Marraige Certificate in their office. The Decree of Nullity has to be published. After you get these documents I am sure the court will be happy to guide you what to do next.

After the publication, the Decision, Certificate of Nullity and Decree of Nullity must be registered in the Civil Registrar of the place where the marriage took place. The Civil Registrar will help you what to do next.

Goodluck and hang in there. . at least you are now waiting for the decision :) and yes Absence does make the heart grow fonder :)

My fiancee had her court hearing in June 07, and received the judges decision November07, and still waiting all the following stamps and seals. Hope it is soon, as that is all that is holding up the K! filing.

Met online August 2006

Meet in Philippines July 2007

I-129F sent to CSC March 2008

NOA2 issued April 2008

Interview July 22, 2008 APPROVED

Arrived USA. POE SFO July 31, 2008

Married September 5, 2008

Filed AOS, EAD, AP September 17, 2008

EAD and AP approved 12/2/2008

AOS approved 02/09/09

Hi

When can i get my Decree of Nullity? I went to Local Civil Registrar to file they i need to waith 3 weeks and call back to fallow up. What is next step? Can i get my Decree of Nullity even i have stil "Entry of Judgement to file motion for custody support of my son."

Please help what i am going to do.

Hi i had my hearing yesterday Nov. 22, 2013. The psychologist hearing is scheduled on Feb. 18. My lawyer said that we had to wait for 1 month to see if my ex would oppose, which i am sure he wouldn't. And after that, had to wait for 3 months for the certificate of finality. My question is, coz we got married in Caloocan, I should bring the certificate of finality at Caloocan, how long will it take for them to forward it to nso and how long will i be able to get it back that it's already done?
