Hi guys, I just got an RFE from USCIS asking for my I-693. The thing is, I already gave them that at my POE last year.

Here is what it says:

Request for additional evidence (I-485)

MEDICAL EXAMINATION (FORM I-693)

NOTE: All medical examinations and vaccinations must be conducted and administered by a physician who is on the list of civil surgeons approved by USCIS. Then some stuff about obtaining names of those surgeons..........

I-693 MEDICAL EXAMINATIONS: Please submit a properly completed and signed form I-693, Medical examination of aliens seeking adjustment of status. The medical examination must be conducted by a physician who is on the list of civil surgeons approved by USCIS.

A review of the record indicates that you entered the united states pursuant to a valid K-1/K-2 nonimmigrant visa. However, the US Department of state did not forward the medical forms DS-2053, DS-3024, DS-3025 and DS-3026 that were completed prior to visa issuance, OR the record shows that over 12 months of time has transpired since you were medically examined in conjunction with your K-1/K-2 visa entry.

Therefore, you are requested to submit the aforementioned I-693, Medical examination of aliens seeking adjustment of status, completed by a physician who is on the list of approved surgeons.

It says I have until August 8, 2007 to submit the information.

So obviously someone has lost my medical exam that I handed over at JFK on arrival. Now should I reply back to USCIS and state that or just get another medical examination done here?? I think its outrageous they can just lose somebodys forms and then expect them to redo them and pay over $300, that should be illegal!

I dont want to risk being denied by not sending them what they want though... please help! Can anyone offer sound advice about where I should go from here? I called USCIS but the woman wasnt very helpful and said I could try getting a copy of my medical exam sent over from England (but i doubt uscis would accept a copy), or I could make an infopass appointment and drive 4 hours each way to Atlanta just to ask them if they would accept a copy of it!

I am so sick of this whole process and the immigration authorities, they are complete idiots.

IF the issue was that DHS misplaced/did not forward your medical, then I can see this as an unfortunate situation, however if the issue is that upon final adjudication of your AOS they see the medical is outdated then I think that is cause for many to worry.

Someone else just reported DHS losing their medical as well - lisaf maybe? in the Feb Filers thread?

i was suggesting by the adjudication date vs. filing date. they did say lost OR outdated; no, it dosent make sense, but who knows, really. let's just hope you are in the "they LOST it" category.

Talk with your doctor. In my case my doctor told me that if something happend with my form then He will keep a copy and could complete a new one for you for no extra cost (in case that your doctor is a good person like mine)...

yup it was me, I got the same RFE. ( word for word)

I had copies of my negative HIV, Syphillis, Tb tests and all titre tests showing immunity to diseases I didnt have vaccinations for faxed from the panel Physician in Australia. Took all that with my DH - 3025 vaccination sheet to a civil surgeon who kindly transcribed all those results ( as they were only 6 months old) onto the I-693 , sealed it etc..... for $140.

Apr 16 - surprise RFE arrives..they lost my medical. New medical returned, Apr 23

Jun 1st - RFE ..more medical BS ( go back for TB skin test)

Jun 28 - CARD PRODUCTION ORDERED!!!

July 06- Green card arrives.

LIFTING CONDITIONS 2009

June 12 - mailed package

June 15 - check cashed

June 19 - NOA extension letter ( card expires June 26th)

July 03 - Biometrics notice

July 14 - Biometrics appointment

OCT 29 - CARD PRODUCTION ORDERED!!!

Get the DS3025 vaccination worksheet from the doctor who did the medical

in your country faxed or mailed to you.

Take it to a civil surgeon here to get it transfered to the I693.

Check around, the fees vary greatly and a reasonable fee is $10-$50.

You will get this form in a sealed envelope from the civil surgeon, ask for

your own copy.

You stated above that you already turned in the I693 at the POE. That is not correct

as only a civil surgeon can fill out this form not a panel physician in your country.

It seems to me this is a standard form and they only want the I693 from a civil surgeon here.

I agree that the medial should be good for 1 year up to time of adjudication.

I would like someone to confirm that though. Who has received the same RFE

wording and only needed the I693 transfer ?

I see you probably had it last March or so, yes? And filed AOS in July. That might mean they are going by the March date as an expiry date not when you filed AOS. Sucks but could be true.

Did you turn in an I-693A with your AOS?

ok so how i am understanding what you said is that you handed over your medical at the POE...right...well that really doesn't matter because when you file for your AOS the person looking at your case will not be seeing that medical..which is why you have to get a whole new medical doen when you file for your AOS...which is why you need that sheet that you handed in because then the civial surgeon can just transfer the info onto the i-693...latley i have been reading that the cival surgeons are demanding a whole new physical and charging 100 plus...

so i guess what you need to do is get a new physical done...sucks i know but from what you are saying...i thnk that is what is needed to be done...

You might just want to bite the bullet and get a complete medical done. They don't issue 2nd RFEs for the same thing, they'll just deny the application instead.

Definately incorrect...if this were the case EVERYONE would be needing new medicals. Some CS can demand that you have a new medical but that doesn't mean you have to use them either. In our experience, we called around to find one that didn't require a new medical and transferred my husband's vaccination information to the I-693A for us.

Miranda, could you contact a CS here and tell them about your situation? Maybe you can get a copy of your medical done in London and have it sent to the CS, if he or she is willing to transcribe it to the I-693 for you. Other than that, it sounds like a new medical will have to be done. Hope this gets resolved soon for you. *hugs*

If I were you, I would just get a new medical. A CS might not be willing to transcribe the info onto a full I-693 since your foreign medical was done over a year ago.

As suggested by someone else, the adjudicator might be going by the date they are looking at your file now and not when you filed AOS. I just think it's better safe than sorry because as I mentioned, they will not issue a 2nd RFE for the same thing, they will just deny the application if they don't get what they feel they need.

guess i should had choosen my words more carefully for some....i guess i should have said some type of medical done all over again...if that is a CS transfering the info over OR a new medical.... But to defend myself you would be supprised at all of the CS i have called not only in Delaware BUT also in PA and a friend of mine who called ALL over MAryland CS saying they will not transfer they need a new medical....

The person looking at your AOS case should have the information regarding the medical in front of them which makes having a new medical unnecessary. That's what we were addressing. If none of the AO's looking at AOS cases didn't have this information then everyone would need new medicals and it would be standard procedure. It is unfortunate that a lot of the CS's refuse to acknowledge medicals that are less than one year old. Just know that doesn't happen everywhere though. It took me an hour or more of calling every single CS on our list to find one that would transfer his vaccinations w/o a new medical.
