Hello  it almost a month, isubmitted my vawa and I haven't gotten my NOA Receipt,is this normal, what should  I do?

Ok talk to Sandra..tell her the situation and see what she advices from a legal perspective! But I think once you get the document, you will be fine! Today is always what we have in our hands, tomorrow remains uncertain! If you have to go..then go!

Most people wait that long too..with USCIS one never truly knows! Even what they display on their site sometimes is not what they follow! If you're trying to get the receipt as proof to hold i485, then you can get a copy of the application and let the officer know you haven't received the NOA! But I think you'll get it soon..it's taking long enough..so should be here any moment now.

Please read previous pages of this forum, lawyers makes a lot of mistake because they are not experience on Vawa. Your I-485 should not be abandoned you can use with your Vawa case and save the fee and you will be able to renew your EAD until you received an approval on your Vawa. Ignoring or abandoning an I-485 which will be denied could put you in removal proceeding.  If your I-485 base on your marriage is still pending you will received interview letter later on attend to the interview if best to go with your lawyer and your I-360 receipt ask the officer to please Hold your I-485 until your I-360 VAWA application is adjudicate. If the officer refuse to put it on hold, than you can file for a new I-485.  We have to be in top of our own case not rely on lawyers, I learned my lesson.

Ok you mean I could send a copy of my vawa to my local office, so as to notify them I dont have my receipt yet.

OMG! I swear I am more of a legal help than that lawyer of yours! Why did he or she say the i485 will be abandoned? Did your ex withdraw the application? If not it doesn't have to be abandoned! It should simply be put in hold while you vawa is processed! Simply go for your interview when it's scheduled, take your vawa receipts present it to the officer, let him know you wish for your i485 to be help pending vawa adjucation. He can agree or disagree..they are allowed to use their discretion. Hopefully the officer holds it! Tell your attorney it can be held and he should do something to make the money you're paying him or her count!!! @sandranj responded to you yesterday..she will be of great help to you.

Cases where you're asking for your i485 to be held, it's better to go there physically than sending in documents! That way you can explain thoroughly and present the document you have! So yes get the copy of your application as proof you have filed for Vawa! Take it along.

I have a question for those who are still waiting for a result and doesn't have any EAD yet, how do you support yourself without work? My resources are depleting and all my friends chipped in already,  I am looking to having an approval after 22 months (that's the max it said) while waiting how do you survive? Especially to those with kids and decided to leave the abusive husband.

You should contact your lawyer, so she/he can request the Receipts. Once requested you should get them within 15 days tops.

Unfortunately this is a realty we all face, best is to have savings to be able to survive. This is the moment were you know who is there with you to give you a hand. I survived 17 months thanks to my 1st cousin that gave me shelter and friends that helped through your the process that I haven’t finish yet.

My savings are already exhausted after 3 years and my friends are not that many :( Just a question, were you able to avail of food stamps while waiting? Or Medicaid? I have a prima facie saying it could be used for "public assistance"

Thanks Sandra. I have a VAWA approval. I am OCt 2017 filer. I was just confused if my I485 was safe. because it was same one i used for my marriage based before the abuse.

Yes You could get Medicaid. got to the public assistance office... with your prima facie....domestic violence victim Shelter is an option  they will help you get the rest with that I-360 receipt and prima facie.

I totally understand your situation even though I've never been in that space..most folks with a prima facie determination use the benefits listed therein! I hope the folks who have actually used them come across your post so they can tell you how to go about it! Better still you can ask @sandranj the attorney on the forum..she has been of immense help to all. Goodluck dear.

Thank you for the response. Do you happen to know if the shelters will house you for a long time until you get approved?
