Hi..I've enquired about this in the past too..and was told that you can divorce you spouse anytime..as you can file for vawa up to two years after you severe the relationship! So I think there's no right time..you actually can do it now but then it's what I've read and being told. There might be other opinions.

You can file in 2 years after the divorce. I filed one year after the divorce. but consult your attorney. Here is the info on the uscis website.

Instead of filing a motion to RECONSIDER, ย not APPEAL, your attorney can call the hotlineย for supervisory review of your case. The motion request will be reviewed by the authorityย that issued the latest decision.

Okay thank you very much..really appreciate your reply..I will suggest this to my attorney right away..but I do hv another question..I and my wife stayed in Vegas for almost a month..that's where we got married and I received my socials before we moved back to our main address in newyork..according to the RFE for good moral behavior I need a certificate of good conduct in places I lived for the past 3yrs..even though I did my newyork police report do I need to go to Vegas and obtain the police report as well?

Hi your case is still young believe me..I think they are still working onย 2017 cases. In good time you will hear. Also when did you move to the USA? If you've been here less than 3yrs, yes you will need to provide good moral character from your home country! Goodluck.ย

You may need to bring good moral character from the country you lived in prior to moving into the USA, and from your present location to be on the safe side.

Been thinking...since you've been here for 3yrs..you may only need to get the GMC report from your location here in the USA!
