Hey guys so my EAD i765/i131 Application filled on August 2018, and mistakenly sent to NBC by my lawyer, by the way I'm still on my 180 days extension till June thank God.  After several service request inquired and getting my congress office involved. USCIS just notify me that they transfer both of my application to another office for processing. I know that office is Vermont which should be the one sent in the first place but lawyers think they know it all, we have to also do our part and push all the resource to fix their mistakes... My questions is does this means i need to wait another long months to get the EAD in Vermont office? I also ask to be expedited with a letter of my employer. Anyone have this transfer experience before.....??

I don't know if we've talked about this before but my lawyer sent mine too to NBC..and truly I was terrified because I know the right place is Vermont but sge wouldn't listen! Thankfully C31 came to the rescue! I've used it to renew my driver's license and updated my i-9 with my employer! I was really worried what I would do before the C31 came through! So far the c9 renewal online says fingerprint review was completed. I guess yours is moving along.

Yes. Is moving along because congress office really call several time NBC, and they finally responded and sent it to expedited on April 18, and today 24th i received notification that it was transfer to another office. My concern is that i have to start in line at 0 in Vermont too....  My pending I485 interview is also for next month.. so i really don't know.

Hi so sorry to hear this! Wow! The things these lawyers do! If you read previous post you will understand how frustrating they can sometimes be! Anyway I'm not an attorney but the idea of appeal sounds better than re filing except you have the patience to wait another two years! I feel bad for you because it was an unfortunate incident! Such a simple RFE! I received a whole 3! To proof good moral character, residence and bonafide marriage and still scaled through! Anyway your lawyer should know that he or she needs to appeal! You will get other suggestions in a bit from the amazing folks we have here. Hang in there!

Thank you very much..I will patiently wait to gt some answers..I really want to know how long the appeal usually takes and considering the situation right now if I stand a chance for my case to be reopened.

Ok it's a reasonable decision! You could send a message to the attorney we have on this forum @sandranj she will be of immense help to you. Goodluck.

Hi @sandranj , thanks for being so active here and giving your best to answer everyone that needs your help. I have a question, I have been offered a job by an employer and he’s willing to send a job offer letter to the immigration to speed up the process. Do you think it’ll work? Have you tried it with your clients? Idk if that’s a good idea. Please help. Thanks!

Yes, I asked USCIS  a few times to expedite the EAD because of a job offer and they expedited.

Hi everyone quick question - when I filed VAWA back in Aug 2018, my lawyer canceled the i485 I filed with my husband (she wrote the letter to USCIS to cancel my interview, we didn’t even get the letter for the interview in first place) and when I check status for that case it says “Case was reopened” and that they would send the notice.

That was in Sept 2018 so they probably mailed something to my old address where I used to live with my husband, so I never received that notice they mailed- what could it be? Did they withdraw my application as my lawyer asked them to? I wanna make sure so I don’t have any problems later on

thanks

Why did he send a letter to withdraw the I -485? it's just unbelievable the stupidity of some attorneys.

I wished I hired you as my lawyer. I didn’t know any better. I called my lawyer yesterday bec I was offered a nursing job in the hospital and he said it won’t do anything to expedite and it’s a matter of waiting for my time! Ugghh. Please help. What should I do? @sandranj thank you so much for your reply

I don’t know, she said it’s better to withdraw and file for a new one, since I never got the interview notice letter. Do you maybe know what would be the “reopen” notice be? Or how can I find out what was in the notice? @sandranj

Hi, everyone.  I have a question to ask.  I have not been with my husband for 2 years and a year ago I applied for my VAWA case.  I wanted to ask if any of you restart your life as a couple with another person and if this affects your case during the process that is approved.

It's my understanding that getting married before your case is adjucated nullifies it. Get more info from others here also.

If he filled the space of EAD that says if you want a social security card then yes after receiving your EAD, like 7 days later you will receive your social security card. You don’t have to go to the office again .For me my EAD came on the 18 feb and then on the 26th i received my social security card .

Good to know! Thanks!

Having a new relationship  does not affect you Vawa Process. But getting Married before is approve will cost your I-360 to be denied, but if remarriage happens after I-360 is approved will not affect the validity of the petition. But in my personal opinion I suggest you to take your time knowing your new partner and focus on finalizing your Adjustment of status.

Thanks for your help. I don't want to get married now. I already suffered a lot with my ex-husband.  It is obvious that I am more careful finding someone.
