Hi everyone quick question - when I filed VAWA back in Aug 2018, my lawyer canceled the i485 I filed with my husband (she wrote the letter to USCIS to cancel my interview, we didn’t even get the letter for the interview in first place) and when I check status for that case it says “Case was reopened” and that they would send the notice.

That was in Sept 2018 so they probably mailed something to my old address where I used to live with my husband, so I never received that notice they mailed- what could it be? Did they withdraw my application as my lawyer asked them to? I wanna make sure so I don’t have any problems later on

thanks

I think they use the picture on file I noticed that the ead that was sent to me under i360 had same picture with my c9 category..actually that's was led me to assume they just use the existing one from biometrics.

Oh okay thank you ☺

Lol...the interview you were supposed to attend with your spouse is cancelled! When you file for vawa, you wouldn't need them to attend with you! You attend alone upon approval of your petition when they schedule an interview. Do you understand this?

Hello house,I have a question.....I went for my marriage based interview alone without my wife cause she has abused me severally both physical and emotion and I have police report and medical report to back it up...but the officer said she will deny my i485 cuz I came without my wife..I tried to explain she still insisted that she will deny it cause the petitioner isn’t there with me...she asked for all my evidences of abuse and joint documents with photos I gave her everything...so she still said she will deny it...but when i got home I checked my status and it says no one appear for interview and when I checked the second day it says request for initial evidence that they want my i360 receipt and I sent the receipt to them since last Wednesday and it has delivered to their address but they haven’t updated the status it’s still in request for initial evidence,I thought they should have updated and let me know they received it cause the deadline is on the 29th of April..so I wanna confirm if they actually received it so I call Uscis and gave them my receipt number for i485 and they told me to write Vermont If I wanna know anything about the i485...they said they can’t share any information about the i485 to me ..they were talking about the i360 but I didn’t even tell them on the phone that I submitted I360..I only gave her my i485 receipt to let me know the status if they have received my i360 receipt...so I’m wondering how she was talking about i360...please what can I do ...I want to be sure if my i485 has been forwarded to Vermont..

Unfortunately some officers are not just nice! They are asking you for evidence of abuse as if it's Vermont center and they are adjucating vawa case! SMH! Anyway for them to be referring you to vermont regarding the i485, it means it probably has been synched to your i360 and Vermont now has jurisdiction. In my case they sent me a letter to inform me Vermont is in charge until Vawa is adjucated then it will be transfered back to their office! You probably should wait for the letter or update..because I saw the update online as well. Obviously it's not denied or else they would have told you so..or you would see the update..they also send letters to inform you as well.

If you read back some posts you will see that they asked him for NOA1 from filing I-360 to hold his I-485.  They were not asking for proof of abuse.

Furthermore, when you file I-360, you are now considered a protected petitioner and anything related to your A# is now protected information, and only Vermont - VAWA Unit will be able to answer your questions.

Two factors that contributed to the slowdown, one is the new security protocols and the other is that the number of U, T visas and  VAWA cases almost doubled. Each year Vermont grants  10.000 U visas, but they have to review over 15.000 U visa cases, over 4.000 VAWA cases and around 3.000 T visa cases  (human trafficking). VAWA Unit has just  225 immigration officers to adjudicate every year at least 21.000 cases, then the petitions are now stuck in the backlog.

Here are the current 1st Quarter Stats for VAWA that supports what Sandraj stated:

I got 2nd update on my i485

first was transfer to new office(NBC) and the 2nd one was kind of the same (local office).

how long does it take for an interview or approval after getting this update for i485 based of vawa approval?

Did you go to interview or just got transfer?

it is impredecible, some people get I485 adjudicated after Vawa Approval in about 4-12 months, average 4-8 months. Some get Courtesy Letter for Medical I693 then get Interview Notice others not... I am

waiting for my Interview Notice too!

10/29/18 Vawa approved

3/13/19 Courtesy Letter

I know thru the forum that people that got CL on February are getting Interview dates set.

I hope this helps!

It happen to me, uscis sends notification to you previous lawyer and ex-abuser.

you won’t get anything, your new lawyer must request the Noa to your ex-lawyer.

the new I485 “reopen” hours to your new lawyer only but you can request a copy from him/her.

I hope this helps.

This is just regarding vawa ,not T and U visas. They received 11.000 vawa cases but it doesn’t mean they adjudicated the 11.000 cases in 2018 , usually they deny 10% to 15% of the cases adjudicated then  they decided probably 4.000 vawa  cases in 2018

Hi @sandranj , thanks for being so active here and giving your best to answer everyone that needs your help. I have a question, I have been offered a job by an employer and he’s willing to send a job offer letter to the immigration to speed up the process. Do you think it’ll work? Have you tried it with your clients? Idk if that’s a good idea. Please help. Thanks!
