You are very welcome. In part your lawyer is right you will get an EAD (work permit) with VAWA but only when is approved not while your vawa is pending this is when he miss inform you!

.... You can only get the work permit with An adjustment status application file along with I765 form and your vawa application... Trust me Lawyers sometimes makes more mistake and miss inform people. This forum will help you a lot.

@FeDaniela is right. This is what happened to me. I thought my I-765 is out of normal processing time,  i filled it with I-360 along with I-485 then we kept sending an inquiries to VSC and didn't get anything rather than an automated msg. then i figured that it is after  I-360 approval and in between I-485. My I-765 case history is  two pages because of my uninformed lawyer. I believe i'm teaching him a lot regarding VAWA. what i want to tell you is listen to the experienced people here and add on your research even if your lawyer is the best.

Finally.. The long wait is over.. Sadly the login uscis account isnt showing this update but when i went directly to their website and put in my receipt number this popped up.. Why have an account to check the status if they're not updating it respectfully?  This is my very first ead filed in November after i realized that the category my former attorney filed (c31) meant i would have only gotten it once my vawa was approved. The received date was november 23 2018

Hi Everyone! I just want to share my experience in using my EAD/AP card. Got my card on hand on March 18, 2019, decided to go to my home country (Philippines) on March 22 (Yes, I flew immediately to take advantage of the low-cost fare :D and also was very excited to see my family). I haven't been home for almost 6 years, so the experience was surreal and it was wonderful to be with my family again. I stayed there for 2 weeks. When I came back, I was brought to another room, waited for 2 mins for the officer to call my name (it was 12 midnight so there was not a lot of people), and asked me only 2 things, 1) "What is your address?'  2) "What food do you have in your luggage"? then he let me go. I was so happy I almost cried while waiting for my luggage. I want to thank @CASTIEL and @FeDaniela for sharing their experiences with me. Prayers really helped me thru. I thank God for hearing them. 🙏

BTW, I also overstayed for almost 2 years and Port of Entry is in JFK-NYC.

@MGJ_NY Wow!! Such great news!! I was so nervous at first, thank God everything went smoothly for you, thank God for journey mercies, welcome back home 🙂

Just a quick note to encourage everyone who hasn't been able to extend their DL by 180 days with the 797C notification.

I consider my case peculiar because my initial 485 was considered abandoned and denied cos the wife(USC) refused to show up for the interview.

Being aware that I had just 2 months left on my EAD based on a C9 category, I went to BMV Hillard today with the 797C notification, SSN, proof of address(Bill), EAD card and the officer helped in getting this done seamlessly. I did have to wait for a little bit but successfully had it extended for 180 days.

Be strong everyone, be persistent and remember "The power of the devil isn't in its gimmicks but in its CONSISTENCY".
I fasted and prayed before going to BMV lol

Tada

By the way, what's the fee for AOS now?

How much money order should I include if submitting 485 with VAWA application?

Hi guys, I have a question about this topic. I have my EAD/AP, pending I-130 and pending I-485 based on my marriage with a US Citizen. I fI file for vawa now, do I need to apply to everything again or can we use the same pending I-130 and I-485? Thank you so much in advance. I thought I was going to have to leave him and walk away from my green card application until I found about this vawa option this morning.

Hi👋😊 you're welcome here and I'm glad you discovered vawa and also this forum! Really great help here. With vawa you don't need the help of your spouse. Gather all evidence of abuse, marriage certificate, bills in both your names same address, therapy session reports, police reports/restraning order, good moral character document etc. You need to have as many as this documents to file. Since you already have a pending i485 you don't need to file another one. When you're called for interview just go and tell the officer you have filed for vawa or want to file vawa so they can hold it for you pending adjucation of the i360 (vawa) if there's anything unclear in what I've said please ask me questions for clarity.

# Did he refuse to carry on with the AOS?

# Have you lots been invited for AOS interview yet? ( 2 years conditional GC, except you lots have been married for more than 2 years)

# Your I30 is irrelevant in this case since you're considering filing VAWA. ( I30 is a petition filed on your behalf by your spouse to adjust status based on marriage to a USC).

# Your I485 could be placed on hold and used towards your VAWA application.

Someone, please shed more light...
