My immigration attorney originally filed just i 360 so my i 765 was on category c31, it took me almost a month going back and forth with my lawyer giving me excuses to not file VAWA and AOS all together since I'm married to an American citizen, with no criminal background or entering illegally

 

She told me it's going to take about 2 weeks to file all the missing forms, so nothing will be completed until April 24th and it probably be until May 24th to get a receipt notices, so best case scenario if the EAD gets approved I won't get it until after September 24th way long after my employer let's me go

 

It boils my blood with anger being the victim and having no protection at all until an eternity passes and my abusive wife can just continue with her life just because she can stay and work by the right of birth, it doesn't matter if we worked to get here legally, it doesn't matter if we are decent people at the end of the day we're just filthy immigrants that steal jobs and we must be treated like ____ on every opportunity

 

I curse her, I curse her obsessive compulsive abusive dad I curse her entire family and descendants, one day the universe will punish them with justice

Please be cautious posting 'hate' in this thread. This is meant to be a positive place. Also if you have a 485 pending and 765 C09 card WHY are you filing another 485/765??? Did your spouse cancel the 485? Did you go to an interview for it yet? Why dont you just keep your current pending 485 and EAD based on marriage?

My wife filed me for 485 based on marriage. A month after she got arrested and got separated from me she withdrew everything.

 

My lawyer filed i 360 with i 765 con category c31.

 

After going back and forth with my lawyer she will finally file i 485 and i 765 on c9p.

 

Her and her family have been constantly trying to ruin my VAWA application, they're vengeful and don't let go.

Ok, so if she withdrew her support for the 485/765 packet then your current EAD based on that packet is NO LONGER VALID. You may have a physical card saying you have work auth until 7/22 but its no longer valid. It became invalid the moment the support was pulled for the 485. You will now have to wait for the C09 EAD based on your 765 you just filed. It can take 4-6 months. Sorry. If you get a prima facie check and see if there are any programs through your local social services that you qualify for.

There is nothing in this world possible that they can do to interfere with your Vawa process. Everything will be Okay.🙏

I have a similar situation at work. EAD is expiring in two month and the new EAD under AOS through VAWA has not arrived yet. What my firm will do is ask USCIS to expedite the case by submitting a letter saying I will lose my job in case the new EAD doesn’t arrive by a certain date. At the same time, the firm’s HR will say that they need me on some projects due to unique skills etc. You can ask your employer to do the same. 

I will also send proof of ongoing therapy (invoices) explaining that losing my job will force me to stop therapy. If you are going through therapy or have some other expenses that might help with the expedite. good luck!

They compliment eachother so to speak..there are documents to submit showing bonafide marriage and some showing shared resisence e.g mails addressed to either of you or both of you to your shared residence(same address) rent/lease receipts..bonafide marriage; bills in both of your names, insurance, phone bills, joint bank accounts, etc..affidavits from you friends and family verifying the relationship from inception through marriage...somehow I hope this sheds some light and helps you understand both the difference and relationship between the two.

For God sake do not use a sample, if you want to have your case denied use some kind of copy and paste affidavit. Each affiant has to write down their own affidavit stating full name, date and place of birth, address and the phone number. They have to mention when they met you, if they met your spouse when dating you, how did they meet and how many times. How long you dated, If they attended the wedding or not, if not why not .If they went to your home after the wedding, if they talked or saw your wife there and how many times. When did they find out about the separation? If they believe that you loved your wife and vice versa, but tell them not to write the affidavit following exactly what I am writing here. Get an affidavit from your mother  or sibling as well.If they do not speak english they can write in their native language the affidavit and a third part can can translate, not you. Look tey don't have to know the abuse in details but at least they need to know why you separated and when you separated .It's impossible you didn't tell at least for one friend what happened.

Does anyone knows what processing time should we follow on the uscis website when you fill under vawa. Is it employment base or family base. I'm trying to see how close I'm at getting an interview date @sandra

I'm sorry if I haven't been following your posts, so you may have posted this- 

 

If you currently have an EAD c09 from your AOS filed with your spouse AND that 485 is pending (not withdrawn) you simply need to file the ead renewal. Filing it on time gives you an NOA as an extension until you get the new card.

 

You can not get c31 EAD expedited because it can't be issued until VAWA is approved. Also if you send in a second 485/765 packet your first AOS package including the EAD you got from it is invalid.

 

The only way what you described happening would be if you are waiting on the renewal- then you can ask for the expedite. Or an expedite on the initial card. But you said you have an EAD? I'm confused.

Thanks for your post here! I have a slightly confusing case. My marriage-based AOS is still pending. The lawyer my ex hired did a very bad job and my old I-485 contains a lot of mistakes, including someone else's name used instead of mine in several cases, if he used my name it was misspelled, addresses missing and incorrect SSN. He didn't want to give me a copy of the forms, and when he finally did, I was shocked that it was even accepted by USCIS. I also filed for renewal of my I-765 back in May 2018, but I never received a renewed document. When my current lawyer saw that, she decided to file a new I-485 and withdraw the marriage-based I-485 to avoid any problems due to these mistakes. I don't know whether it was a right decision, but it's already done. I will be withdrawing the old I-485 by the end of the month, and I am currently waiting for the new EAD based on the new I-485 the lawyer submitted.

 

P.S. I was talking about EAD C09

@sandranj. Can you please suggest me what to do? 

 I filled for VaWa Feb 2017 got rfe in May 2018 replied in Aug 2018. Have not heard anything from uscis. I did senator enquiry twice once in November and other in February. Both the times senators office told me that they got reply that it's pending with background check. 

I don't understand what to do. 

Can I contact ombudsmen ? Do they really help? Will it have negative impact on my case? 

Please somebody help, I will go crazy thinking about this.
