This attorney had told me I was not elegible to apply for EAD until they approved my VAWA, so I didn't for almost 6 months after I applied VAWA 😱 my abuser is a USCS and I already had a pending i-485 and epired EAD. The only useful info has been this website that I thank God for.

I totally understand dear believe me..the only reason I haven't or rather didn't fire my lawyer was because of the correspondence issue..I didn't want any issues with my petition. Vermont takes forever to update address change..I just wanted the whole thing to go smoothly. Imagine my lawyer telling me ignorantly that we didn't apply for card under vawa that how come I'm saying card was mailed out to them under vawa..I had to patiently school my lawyer who I am paying! 😂😂😂 I just wish I could get my money back! My lawyer still doesn't know that my vawa has been approved because the approval letter is yet to reach them and they don't understand what "card has been mailed out" means under vawa! I'm glad I knew well to be proactive about my case!😏😏

The lawyer information was incorrect. You could of have renew your EAD while your i485 was pending and got an extension of 180 days if you renewal was on time, and waited for the EAD renewal to arrived. You can still apply for an EAD to VSC if you still have your i485 pending, sent copy of the receipt along with i765 form. Your husband was an USC.  The wait time to apply for EAD / AP is when the abuser is an LPR, then after the approval you get an EAD and move foward with I485 base on priority date. etc...

I did have a lawyer who filed for me originally but I had to fire him. He didn't know anything about VAWA just collecting money and he said supposedly he didn't receive anything for me.

It's said that 99% of lawyers give the rest a bad name. :P

Sandra, here, is the shining exception, of course.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Anybody knows if they would adjudicate an EAD renewal and Advance Parole (I-331) under C9 category although I am already divorced and pending VAWA and RFE

The question is if you have a pending I485??

This here is true! Thankfully Sandra has been so helpful. Frankly if I had joined this forum much earlier, I would have fired my attorney! But I have no worries now that my case has been approved! I recommend Sandra to anyone who has hit a brick wall in their case.👍

I agree, I filed my original I-485 package with abuser by myself. I only wish I was confident enough to file by my own but I've waited for so long that I no longer care about the "ifs, were should've" LOL

I think having a pending i485 and being that your spouse is USC qualifies you for the EAD under co9. Even for 1360 only that most people don't want to apply alongside 1360 until it has been approved to avoid been in removal proceedings if it's denied! I don't know if this makes sense.

What's 1360, I apologize for my ignorance 😬
