You were not legally old enough to be married at the time

You were forced into the marriage

You were not mentally competent when you entered into the marriage

Your marriage was fraudulent (green card fraud, criminal history, sexually transmitted diseases or impotence) **** which this is the one your abuser wants to file for***

 

I AM NOT SURE YET ABOUT HER MOTIVES. SHE JUST THREATENED ME THROUGH A COMMON FRIEND. I AM NOT CONTACTING HER. SHE WANTS TO TALK TO ME AND I AM AVOIDING HER BY ANY MEANS. SHE HAS NO REASONS OTHER THAN FRADULENT MARRIAGE BUT I HAVE WITNESSES AND MY FRIENDS TO HELP ME OUT IN THE COURT. THEY HAVE ALREADY GIVEN ME THE STATEMENTS FOR VAWA APPLICATIONS

If you didn’t apply to obtain work permit you should not work, but If you submitted form l765 over 90 days ago and you didn’t get the work permit contact your Congressperson and ask him to inquire on your behalf ASAP ,and in this case you don’t have to stop working because the EAD delay was not caused by you, you  should not have a problem because of this ,but contact your congressperson today.

When am am I officially divorced is it when I sign the papers it is finalized? 

Like @Ziongirl adviced, you can still file for vawa if you are divorced within the two year frame prior to filing! I don't think your spouse filing first or you makes any difference..as long as there was a qualifying relationship in this case (marriage), then you meet the criteria for vawa! Still you may want to hear from Sandra or any other attorney! Goodluck!

EAD are taking form 5-8 months Now, (The longest time of the history of USCIS) the processing time they have now is October 2018 to make an inquired you are under processing time according to them....  Do you have 180 days extension???

Obviously it's taking longer than usual now. I've heard reports of 5months and above! I applied for a renewal Feb2019 they said it's still under processing! I'm even surprised you have not received yours considering you're a January filer! Wow! I hope I don't have to worry about EAD again before my greencard interview! I'm presently working with my c31 EAD from vawa approval!

She can file for divorce.  It will not affect your VAWA as you filed prior to the divorce.  My suggestion is to divorce and move on from your abuser. Your divorce is not official until the judge consents to the divorce.  Signing the paperwork is the beginning.  If you think it is going to be a problem, you need a lawyer.

I have traveled, twice with my EAD/ AP thru JFK, No problem at all... secondary check up and couple questions and done....
